Bernie Glen Domestic Water Improvement District has come to us before. It was tabled last time because of the pending litigation 00:02:39
and so forth and apparently that was resolved and so now they have submitted their petition in the process once again to establish 00:02:45
the working Plan Domestic Water Improvement District. 00:02:51
And so at this point in time for you notices were sent out that there was to be a hearing on the formation of the 30 Glenwood. 00:02:57
Was posted in the newspapers as required by statute. 00:03:06
And the Corporation Commission we know applied, and so we did send out letters to the individuals residing within the proposed 00:03:09
district. 00:03:12
We received four that were returned for bad addresses. We received the fifth one last night at the last minute on our on our mail, 00:03:17
but we could not. 00:03:21
We address that one and send that one back out, but the other four we did last week, something back out. Hopefully they got their 00:03:26
notifications of this meeting. 00:03:29
And that they were able to attend or not. So at this time, the public hearing is just for the commentary from the public that they 00:03:33

My family and I live there. 00:05:03
And I'm here to really represent. 00:05:05
Not only individually as a as a homeowner and property owner in that. 00:05:08
Neighborhood and association. But also, I've served in the last nine months or so as the board president for the Birdie Glen 00:05:13
Property Owners Association and had been a board member since I've lived there since November of 2020. 00:05:19
The role I took really as part of the board was the operational liaison. So that means because the the property owners association 00:05:27
owns the water company. 00:05:32
And is responsible for delivering and ensuring we have water service to the community. That means I got pretty neck deep and 00:05:38
involved in understanding the assets that we have. 00:05:42
The capabilities of those assets, the challenges or weaknesses of those assets and also in administering an RFP to seek out a new 00:05:47
water operator back in that 2020 time frame. In that time, we've had a couple of incidences. One was referenced in the letter that 00:05:53
the former President, Bill Remy had sent to the Board of Supervisors. Hopefully everyone's had a chance. Perhaps Supervisor 00:05:59
Humphrey, you haven't had a chance yet to read this. 00:06:06
But I think it was sent yesterday. 00:06:12
And he did a good job of articulating some of the challenges that we've had just simply with our aging infrastructure. Much of the 00:06:15
infrastructure was put in originally back in 1960s, some of it even 1950s that is still in service and is primarily serving the 00:06:21
community, including the pressure tank for Vertigo and 1:00 and 2:00. 00:06:27
And then also much of the piping infrastructure and things like that. We've had a couple of incidences since I've lived there in 00:06:35
just the last few years that have. 00:06:39
Brought some concern to me and to others in the community about the longevity and the likelihood of maintenance needs and 00:06:43
replacement needs and things like that in terms of duty cycles and such for that equipment. We don't really have backup equipment 00:06:49
either. And so as we looked at as a board what the cost might be and what the options would be. 00:06:55
To fund. 00:07:02
Some replacements and upkeep, it really is a non starter to do it ourselves. We've operated well ourselves for a long, long time. 00:07:03
But at this point with the age of that equipment and some of the experiences that we've had in the last year that just make it 00:07:11
obvious we're going to face more and more reliability issues in the future. And by forming A DWID, we hope and expect that we 00:07:18
would at least have access to and different standing to perhaps have access to funding sources that could support. 00:07:26
Our our maintenance and upkeep needs and and reliability improvements overtime. So, so again it's just a simple you know, property 00:07:33
owner and family man who lives there full time and relies on that water source every single day for my family and I. 00:07:41
And then also as a board member and current board president, I'm certainly in favor of the Board of Supervisors voting to approve 00:07:48
as does the petition suggest most of the homeowners also would would like to have this grid. And so I thank you very much and 00:07:55

For considering the matter then, and will be being willing to hear this back, It's been a contentious issue. That's just the 00:09:43

There was a lawsuit that was filed. I think that my sense of. 00:09:50
What held us up last time was this lawsuit and that there was perceived uncertainty about the lawsuit. 00:09:54

I'd like to talk just briefly about the lawsuit is what happened with the lawsuit, And I wish, I'm still kicking myself happy in 00:10:02
here at the last minute, honestly. But what the lawsuit had to do was there was an ownership question in terms of some of the 00:10:07
assets and the people involved, in particular my clients who are a group of residents. 00:10:13
And the Property Owners Association, which is the defendant, a defendant in the case, among others, did the right thing. 00:10:19
And got together and immediately worked to try to get things worked out and reached an agreement to a lot of hard work which 00:10:26
involves essentially the agreement that. 00:10:31
Um, the assets of the association would hopefully be turned over to it with. 00:10:36
Uh, and that's why we're here today as that agreement was reached. 00:10:41
The lawsuit was settled. There was some remaining issues that a group had raised about winning an award of attorneys fees out of 00:10:45
the lawsuit. That was considered by Judge Wright and that was the name. And so I have the final judgment here. If anything you'd 00:10:51
like to see it or or not. But it was the loss that's been over and the final judgment entered quite some time ago. So this, this 00:10:57
lawsuit is done. It's time for this community to move past this and move forward. 00:11:03
Towards what it really needs, which is improvements to the infrastructure. I I heard Mr. Winston speak and would just echo those 00:11:10
comments this this is a system that went out for a number of days last summer with nobody having anyone. 00:11:16
And that's not, that's just not acceptable. The Dwayne will allow for additional funding opportunities and standing for funding I 00:11:22
believe is well put that I don't think that the association would have. Then it's just time for for the community to come 00:11:28
together. That's why the settlement was reached. They won't get to the real business, which is getting this water system fixed up. 00:11:34
So there's not problems in the future, I would like to say that. 00:11:40
When this petition came before the board last time. 00:11:46
I believe there were 32 out of 46 inches. Don't hold me to this these numbers, but around 46 total property owners around 32 00:11:52
signatures the first time. 00:11:56

Needed to be recirculated. 00:12:04
And we came back with more signatures. So there were allegations. I don't know if the board recalls, but there were some 00:12:06
allegations in the last. 00:12:10
Meeting that this lawsuit people have been. 00:12:14
Pressured to sign, and there have been some, you know, shady practices, for lack of a better way of putting it. In terms of the 00:12:17
way the presentations were circulated, that was nonsense. 00:12:21
And it's proven by the fact. 00:12:26
That more people. 00:12:28
Have now even come back and signed and signed the first time. So these this all took place after this this new petition all took 00:12:29
place after the lawsuit was over. 00:12:33

There's just an overwhelming support in the community, roughly 35 out of 46 property owners. 00:12:39

I'd like to talk just briefly about the lawsuit is what happened with the lawsuit, And I wish, I'm still kicking myself happy in 00:10:02
here at the last minute, honestly. But what the lawsuit had to do was there was an ownership question in terms of some of the 00:10:07
assets and the people involved, in particular my clients who are a group of residents. 00:10:13
And the Property Owners Association, which is the defendant, a defendant in the case, among others, did the right thing. 00:10:19
And got together and immediately worked to try to get things worked out and reached an agreement to a lot of hard work which 00:10:26
involves essentially the agreement that. 00:10:31
Um, the assets of the association would hopefully be turned over to it with. 00:10:36
Uh, and that's why we're here today as that agreement was reached. 00:10:41
The lawsuit was settled. There was some remaining issues that a group had raised about winning an award of attorneys fees out of 00:10:45
the lawsuit. That was considered by Judge Wright and that was the name. And so I have the final judgment here. If anything you'd 00:10:51
like to see it or or not. But it was the loss that's been over and the final judgment entered quite some time ago. So this, this 00:10:57
lawsuit is done. It's time for this community to move past this and move forward. 00:11:03
Towards what it really needs, which is improvements to the infrastructure. I I heard Mr. Winston speak and would just echo those 00:11:10
comments this this is a system that went out for a number of days last summer with nobody having anyone. 00:11:16
And that's not, that's just not acceptable. The Dwayne will allow for additional funding opportunities and standing for funding I 00:11:22
believe is well put that I don't think that the association would have. Then it's just time for for the community to come 00:11:28
together. That's why the settlement was reached. They won't get to the real business, which is getting this water system fixed up. 00:11:34
So there's not problems in the future, I would like to say that. 00:11:40
When this petition came before the board last time. 00:11:46
I believe there were 32 out of 46 inches. Don't hold me to this these numbers, but around 46 total property owners around 32 00:11:52

And we came back with more signatures. So there were allegations. I don't know if the board recalls, but there were some 00:12:06

Pressured to sign, and there have been some, you know, shady practices, for lack of a better way of putting it. In terms of the 00:12:17
way the presentations were circulated, that was nonsense. 00:12:21
And it's proven by the fact. 00:12:26

Have now even come back and signed and signed the first time. So these this all took place after this this new petition all took 00:12:29
place after the lawsuit was over. 00:12:33

There's just an overwhelming support in the community, roughly 35 out of 46 property owners. 00:12:39
