Testing. Testing.
00:00:04
Test.
00:00:05
OK.
00:00:07
Yeah.
00:00:11
I can certainly try.
00:00:20
One more.
00:00:24
Off first. Wow is it going by quick.
00:00:25
So are we ready and patient?
00:00:28
Actually.
00:00:35
Hey there, we getting patient to go?
00:00:38
But.
00:00:42
OK, good deal.
00:00:43
Cassie, you're ready.
00:00:45
Alright, I'll go ahead and you guys get.
00:00:47
Alright.
00:00:50
I'll go and open the meeting August 1st. It's 10:00 o'clock. Randy, You want me to send the pledge And then Richard Contrado from
00:00:51
Calgary Church will do the invocation.
00:00:56
I thought.
00:01:03
Ohh.
00:01:14
Thank you.
00:01:20
Heavenly Father God, we give you thanks for this day, God, and for your many blessings that you pour out on us.
00:01:21
And God, for this meeting today, God for the issues that will be discussed and for the decisions to be made. God we we ask that
00:01:27
you would give us wisdom of God, that you would give us discernment and all things God. And again we we pray for a blessing. God
00:01:33
for your hand to be upon us all here today. Father God, for this we give you thanks. We give you praise. In Jesus name we pray.
00:01:38
Amen.
00:01:44
Yeah.
00:01:50
Thank you, Sir.
00:01:51
OK, we'll start with #2 presentations.
00:01:55
2A Presentation regarding the activities of the Arizona Department of Environmental Quality.
00:01:59
In HeLa County and we have a map in order.
00:02:04
Matt, good morning. Come on up and.
00:02:08
Let's know who you are and who you're with and.
00:02:10
Great. Thank you. Yeah, my name is Matt Narder. I'm a hydrogeologist with the Arizona Department of Environmental Quality. And so
00:02:14
we really appreciate your time here this morning allowing us to come and speak and have a busy agenda.
00:02:20
Umm.
00:02:26
So the reason that I'm here is the US EPA is proposing to regulate a new group of chemicals. They go by the acronym PFS or we call
00:02:28
them PPAS.
00:02:32
And these proposed regulations, they're gonna have an impact all throughout Arizona and here in the county, particularly drinking
00:02:38
water providers. So one of the regulations that they're proposing is to limit the amount of these chemicals that can be in our
00:02:43
drinking water.
00:02:48
So.
00:02:53
Our drinking water systems throughout the state are going to have to comply with these limits.
00:02:55
And so ADQ is working throughout the state and here in the county with these water providers, we're helping them to sample.
00:02:59
To understand what's in their water and to to be prepared for these new regulations.
00:03:06
So we've got a short video here that's that's going to play. It's kind of just a brief overview kind of introduction to to what RP
00:03:11
fast and then talks a little bit in general about what's going on throughout the state. And then I think that you've been provided
00:03:17
fact sheets that talk more specifically about what's happening here in the county.
00:03:23
So I think after the video I'd be happy to go through this in more detail. You may have seen that.
00:03:29
There's a number of drinking water providers here in the county that have PCs in the water. And so I'm happy to talk about what
00:03:35
we're doing to work with those water providers and get them prepared.
00:03:40
Good.
00:03:45
OK, so we have again playoff step. Sorry.
00:03:46
There's a term for a group of chemicals that many Arizona residents are likely to hear more about in the coming years.
00:03:49
We had 80 Q would like to provide you with a brief introduction of PFAS in Arizona so you can understand what PFAS are, what EQ is
00:03:56
doing to address these chemicals in our environment and what steps to take now to protect your health.
00:04:02
1st it's important to understand some basic facts about PFAS.
00:04:10
PER and polyfluoroalkyl substances, or PFAS.
00:04:15
Are a large family of man-made chemicals that have been in use since the 1940s.
00:04:19
PFAS have unique physical and chemical properties that make them very useful for a wide range of applications.
00:04:24
Most notably stain and water resistance.
00:04:30
But these same properties can make them highly stable and resistant to degradation in the environment, earning them the nickname
00:04:33
forever Chemicals.
00:04:37
Because the length of their carbon fluorine tail and the structure of their functional head can vary.
00:04:42
Thousands of unique PFAS molecules are possible.
00:04:47
Some peace out there, been more commonly manufactured than others, including two of the most widely used and studied PFAS
00:04:51
molecules.
00:04:55
PFOA and PF OS.
00:04:59
Scientific studies have shown that exposure to some PFAS may be linked to harmful health effects in humans and animals.
00:05:02
Depending on how much PFAS someone is exposed to and for how long, certain PFAS can have potential harmful effects, for example
00:05:09
increasing the chance of getting some cancers, increasing cholesterol levels.
00:05:16
And affecting reproductive health and child development.
00:05:23
Because of their unique and beneficial properties.
00:05:27
Peasants have been incorporated into many common consumer products including carpets, furnishings, food packaging, cosmetics,
00:05:30
clothing, cookware and many others.
00:05:36
In some cases, consumers can choose to limit their exposure to PFAS, for example by avoiding products labeled as water or stain
00:05:42
resistant.
00:05:47
Avoiding food in contact with grease proof packaging.
00:05:51
And avoiding personal care products with fluorinated ingredients on the label.
00:05:55
Drinking PFAS contaminated water is another potential source of exposure, but one that for many is not easily avoided through
00:06:00
personal choice alone.
00:06:04
However, in most cases, exposure to contaminated drinking water can be eliminated through testing, regulation and treatment.
00:06:08
Something we'll discuss more in just a bit.
00:06:16
The life cycle of Pfaff starts when they are first manufactured by industry.
00:06:19
Although Arizona has not historically been home to any PFAS manufacturers, these chemicals can make their way to our state through
00:06:23
the purchase of consumer products.
00:06:28
The use of firefighting foams.
00:06:33
And as raw materials used in the production of other products.
00:06:35
People may be exposed directly from using these products, but as they are used or thrown away, they also enter our landfills and
00:06:40
our wastewater treatment plants.
00:06:44
And in turn can be released into the environment where they can accumulate and do not easily breakdown. From there. They may end
00:06:49
up in our food or our drinking water.
00:06:53
With PFAS so common in the world today, it's not surprising that we find these chemicals in our bodies as well.
00:07:00
The CDC has measured PFAS in the US population since 1999 and has found that PFAS are present in the blood of 99% of Americans.
00:07:06
However, since 2002 the production and use of two of the most common PFAS, PFOA and PF OS.
00:07:16
Has declined, and researchers have seen a corresponding decline in blood levels.
00:07:25
In the case of PFOS, by more than 85%.
00:07:30
Therefore, despite their forever chemical nickname, we can see that reducing exposure to these chemicals can have a positive
00:07:34
impact on the levels in our bodies.
00:07:38
These thoughts are not currently regulated at the national level or in Arizona.
00:07:43
The US Environmental Protection Agency first released provisional PFAS health advisories in 2009, which defined advisory levels
00:07:48
for PFOA and PF OS.
00:07:54
Since that time, the advisory levels have been revised lower, first in 2016 and again in 2022, and were expanded to include
00:08:00
additional compounds, PFBS and Genex chemicals.
00:08:06
Health advisories are not legally enforceable. They identify the concentration of the contaminant in drinking water at which
00:08:13
adverse health effects are not anticipated to occur over a lifetime.
00:08:18
In March 2023, EPA took the next step.
00:08:25
After many years of study and recent research, EPA proposed a national primary drinking water regulation.
00:08:28
The proposed regulation would create a maximum contaminant level, or MCL, for six common PFAS.
00:08:35
And MCL is the maximum concentration of the contaminant allowed in drinking water that can be delivered by a public water system.
00:08:41
EPA has proposed to regulate PFOA and PFOS at a level of four parts per trillion, while four other Pfas are proposed to be
00:08:49
regulated as a mixture using a standard calculation called a hazard index.
00:08:56
These proposed MCL's were developed by EPA to account for chronic exposures to low levels of PFAS over time at concentrations
00:09:03
typically found in drinking water. They're not dangerous in the same way as acute water contaminants like E coli, which may be
00:09:09
dangerous if consumed even once.
00:09:15
It may be helpful to understand the unit of measure that's being used by EPA for the proposed regulation. One part per trillion is
00:09:22
equivalent to a single drop of water in 20 Olympic sized swimming pools.
00:09:28
So this hopefully gives you an idea of just how small these numbers really are and also how cautious EPA is being about the long
00:09:34
term risks associated with exposure to PFAS in our drinking water.
00:09:40
18 Q is closely following Pfaff developments at the federal level, and the EPA has developed a road map that lays out their
00:09:46
commitment to take specific actions.
00:09:51
It's expected that EPA will finalize the proposed drinking water regulation within the next year.
00:09:56
However, implementation of the final rule will occur three years later, giving States and water providers the time needed to
00:10:01
address contamination.
00:10:06
In addition to drinking water regulations, EPA has proposed designating certain PFAS as hazardous substances.
00:10:11
Which would allow the state and federal government to hold polluters accountable.
00:10:18
An EPA has also proposed aquatic life standards to help protect wildlife in our streams and rivers.
00:10:22
These are all just a few of the many federal PFAS developments that are expected over the next several years.
00:10:29
So what is ADEQ doing about PFAS in Arizona?
00:10:36
And Q is taking several steps to protect public health and help our state prepare for future EPA actions.
00:10:39
Beginning in 20/18/80, Q conducted targeted screening efforts to understand the scope of PFAS impact in Arizona.
00:10:47
This testing included drinking water, groundwater, wastewater and biosolids.
00:10:55
In 2023, we began A comprehensive PFAS testing program to make sure that all of Arizona's regulated drinking water systems are
00:11:01
sampled for PFAS in advance of federal regulations.
00:11:07
If PFAS are detected, we can begin working right away with affected water providers to collect more data, find solutions and
00:11:13
identify funding to reduce exposure to PFAS.
00:11:18
We'll have more details on this important program in just a moment.
00:11:24
While we're actively working to protect drinking water, we're also trying to identify the most effective ways to prevent more PFAS
00:11:27
from entering our environment.
00:11:32
Any Key recently piloted a program to help Arizona fire departments stop their use of PFAS containing aqueous film forming foams
00:11:36
known as a Triple F.
00:11:41
The program was allocated $395,000 during fiscal year 2023, which allowed us to take back and replace foam from over 50 fire
00:11:47
stations, removing over 9000 gallons of PFAS containing foam from being used. We had 275 gallons that we no longer brutalizing
00:11:53
because of risk.
00:11:59
Had truck easily pulled up, loaded it and unloaded that at 500 that will now be able to distribute to our drugs.
00:12:06
Being involved in this program and it was so essential and critical for us to get rid of these chemicals.
00:12:14
As mentioned earlier, Aiding and Q is currently engaged in a comprehensive statewide effort to ensure that all regulated water
00:12:19
systems are tested for PFAS.
00:12:23
EPA is currently requiring that systems serving 3300 customers or more sample their drinking water for PFAS.
00:12:28
However, in the state of Arizona, the majority of systems serve fewer than 3300 people and will not be sampled under the EPA
00:12:36
program.
00:12:40
Therefore, 80 Q has committed to using $3 million of federal Safe Drinking Water Act funds to sample these small water systems and
00:12:44
help ensure that all regulated water systems in Arizona will be tested.
00:12:50
Results are generally provided to water systems within two to four weeks of sampling and are posted to the ADQ website.
00:12:56
If PFAS are detected, 80Q provides the system with the PFAS toolkit, especially developed to help water systems meet the
00:13:03
challenges of this may cause.
00:13:08
The toolkit includes information on funding, customer communication and potential next steps.
00:13:14
Systems are asked to follow EPA recommendations to inform their customers of the results.
00:13:20
Our program to test small drinking water systems has a number of benefits for the systems and their customers.
00:13:26
First, it provides PFAS sampling to systems at no charge, potentially saving them thousands of dollars.
00:13:32
These systems can then be notified of PFAS detections much earlier than if they wait until they are required to sample under
00:13:39
forthcoming federal regulations.
00:13:43
For those systems with PFAS concentrations higher than the EPA's proposed limits, they can get a head start planning for expanded
00:13:49
testing, evaluating potential solutions.
00:13:54
And applying for federal funding if necessary.
00:13:59
With many systems across the nation facing similar challenges, it's important that Arizona's drinking water providers begin
00:14:03
planning to meet the new rules as soon as possible.
00:14:07
So what can you do if PFAS is detected in your drinking water?
00:14:12
If your water is confirmed to contain PFAS, in many cases action is not necessary immediately. You can choose to reduce your
00:14:16
exposure as soon as possible by not using untreated water for activities like drinking, cooking, washing produce, brushing teeth,
00:14:22
or preparing formula.
00:14:28
However, it's generally safe to continue using untreated water for activities like washing dishes, showering laundry, swimming and
00:14:34
watering your yard.
00:14:39
If you have concerns about PFAS in your water, there are a number of at home treatments available such as activated covenants and
00:14:44
verse osmosis.
00:14:48
You can check sources such as the NSF.
00:14:53
Or your local filter installer For more information on effective treatment systems for your home.
00:14:56
It should be noted that boiling water will not remove PFAS and bottled water providers are not required to test for PFAS, so use
00:15:01
caution if you choose to drink bottled water.
00:15:06
Pizzas can be a complicated topic and this presentation is meant only as a brief introduction.

00:15:38
Xbox recently?
00:15:43
Any questions I can answer? I'll bet there are Matt. Supervisor, Humphrey.
00:15:47
Well.
00:15:51
I I don't have a lot of questions.
00:15:52
Because it was pretty explanatory and went through it, and they're going to be checking for it and it just seemed like they're
00:15:56
going to sell an awful lot of osmosis purifiers because boiling water, nothing else will fix it.
00:16:01
So.
00:16:08
I I that that's what I got out of the presentation.
00:16:10
And you know, I mean.
00:16:13
And the funding for?
00:16:15
All of this is, you know, it's it's for the water companies.
00:16:17
Not necessarily the individuals that want to put a purifying system.
00:16:20
On their home, is that correct? Correct. But the hope is that the the water systems will install treatment or find other ways that
00:16:24
there's other ways to lower exposure to PFAS. So you know maybe turning off an impacted well if there's multiple wells versus them
00:16:31
or or other things. But the hope is that the systems will be serving clean water, so that this.
00:16:38
The burden doesn't go into the customers. And is this a federally?
00:16:46
Funded.
00:16:49
Process.
00:16:51
So, so there is funding available to these water providers to help them initially.
00:16:53
Eventually the you know, the cost of running the system with additional treatment will likely be borne by the water providers
00:17:01
themselves, but there's a lot of funding available initially for systems to to help them find solutions to this.
00:17:09
I I mean.
00:17:17
The the people that are testing the systems.
00:17:19
Is that a federally funded program? Yeah, so, so, so it's it's sort of both. So the larger systems that's a federally funded
00:17:22
program, EPA is requiring these systems to to treat, but most of our systems in Arizona are smaller systems.
00:17:29
And so that's where AQ stepping in now. We are using mostly federal funding to do that, but it's actually a DQ that's stepping in
00:17:36
and doing the sampling right now.
00:17:40
Thank you, Mr. Chair.
00:17:46
Thank you.
00:17:47
Supervisor Christensen.
00:17:48
Thank you, Chairman. Thank you, Matt. Very interesting. I've never heard of it before.
00:17:49
And.
00:17:55
You're saying that this does not naturally occur in our water. These are 100% chemicals.
00:17:56
So when I see Christopher Creek, Jakes Corner Rim, Trail, Strawberry, how, I mean how those are very rural areas. So just
00:18:02
interesting to think first of all.
00:18:07
A part per trillion is an extremely small.
00:18:13
Number. I don't even know how you find something that can test that, but.
00:18:18
You know, that's a million, million parts.
00:18:22
So yes, anyway.
00:18:25
It's, it's how dangerous is this really and how does it end up in our rural areas? Yeah, so, So one of the things that kind of
00:18:27
sets PFAS apart from a lot of other chemicals that we deal with is the fact that it bioaccumulates. So it can accumulate in plants
00:18:33
and animals and can accumulate in our bodies. And that's part of the reason why EPA is concerned with such low levels because
00:18:40
essentially our our bodies can't pass it out.
00:18:46
Fast enough or faster than it's coming in and so it'll tend to build up. So even though we might be drinking these low levels, it
00:18:53
can build up overtime. But you are right, these are very, very low numbers. The EPA, you know is looking at all sorts of
00:18:58
uncertainty factors and trying to make sure that they're.
00:19:04
Limiting this as much as possible and what we're We're drinking.
00:19:11
OK.
00:19:16
Alright.
00:19:16
If something is passed legislatively, how will that affect us?
00:19:18
Meaning if the border supervisors or.
00:19:24
The county.
00:19:27
So, so I think that the biggest thing is these making sure that these drinking water providers are are able to come incline, so
00:19:29
you know for example for the county. So first of all we want to come here to make sure that you guys are informed of what we're
00:19:36
doing that we're doing the sampling. So if you're going to questions about you know some of the sampling or these results, you
00:19:44
know what's going on but then beyond that to be able to advocate for for funding so we have a a small water system fund.
00:19:51
That it's really important that that gets funded because those funds go directly to these small water providers to help them in
00:19:58
situations like this.
00:20:02
So being able to help advocate for that on things like you saw the.
00:20:07
Are the Triple F removal program so going to these rural fire departments and helping them to change out because that could be
00:20:11
expensive to change out the the firefighting foam that had PFAS in it.
00:20:17
So, so being able to find systems like that that that would be a real help from.
00:20:23
OK. I appreciate it, Matt. Thanks. Thank you, Chairman.
00:20:27
So Matt, did did you say in there that they don't test these?
00:20:31
Correct. How come?
00:20:35
Well, the FDA is, is in charge of rules for bottled water. It's not the EPA, it's the FDA, it's a food product. And so they, they
00:20:37
don't have any regulations right now that requires bottled water providers to test for it. So it's not necessarily saying that
00:20:44
it's there, although some studies have shown that there are. They've shown PFAS and bottled water, but we just don't know.
00:20:51
So because they're not testing for it, I that that kind of amazes me because everybody drinks these, you know, bottled water these
00:20:58
days.
00:21:02
Yeah.
00:21:06
Well, thank you for your presentation.
00:21:07
Thanks for coming out and taking time. And Mr. Chairman. Yeah, of course. Yeah, go ahead on the handout that you that is being
00:21:09
shown up here. We've got a list of water companies in HeLa County.
00:21:15
There's certainly not all the water companies and Henry County that are listed.
00:21:22
Most notably Clove and Arizona Water Company. That's in.
00:21:26
Right here in.
00:21:30
Gold Miami area.
00:21:31
Why are they not listed and does that mean well?
00:21:33
Yeah. So that's a really good question. So what's, what's on the fact sheet, This is our AQ's program to sample the smaller water
00:21:37
providers. So the larger water providers are being sampled by EPA and that sampling is ongoing over the next couple of years. So
00:21:43
we don't have those results in yet. The water providers themselves, for those larger water providers, they're going to be doing
00:21:49
the sampling and then and then they're going to be getting those results back. AQ won't get them directly. So what these are are
00:21:55
all the smaller.
00:22:01
Other providers that we've gone out and sampled and then actually this list is subset of those.
00:22:07
Because this is just showing the systems where we've actually detected Ppas.
00:22:12
There's a number of systems, so it's 46 total systems that we've sampled to date.
00:22:17
And of those, 28 which are listed here have had PFAS detections.
00:22:21
Mr. Chairman, So there's of the 28 that are listed, there's some that say, yes, that means they're above the one park trillion.
00:22:26
If they say no, then they're they're detected below the one part trillion. Yeah, so, so the the limit there that the yes or the no
00:22:33
is what EPA is proposing is the limit.
00:22:38
Um, so.
00:22:43
Primarily it's about four parts per trillion depending on the chemical. But yeah, so the ones that say yes are.
00:22:45
Would be if the proposed regulation is put into place, those would exceed the regulation. They would need to do something to to
00:22:52
lower the amount in their water.
00:22:56
Thank you, Mr. Chairman. Mr. Judge, just one question.
00:23:01
You say that the PFAS is in the firefighters foam that they're trying to replace.
00:23:04
About the slurry that's dropped on rural fires.
00:23:09
Is it contain it? It's a really good question. No, in general it does not. Those are phosphate based. So P pass is used primarily
00:23:13
to control liquid fuel fires because the gasoline OK.
00:23:19
You know, cause we we get a lot of fires and have had a lot of fire. So just a question that came up. Yeah, great question. Thank
00:23:26
you very much.
00:23:29
Matt, thank you. Thanks for being here. Thank you.
00:23:34
All right, on to the TB public recognition of three employees through the County Spotlight on Employees program as follows. Reyes
00:23:38
Barajas, Larry Dooley and John Desera and we have Erica this morning.
00:23:45
Good morning. Morning.
00:23:51
Again, thank you so much for your time today.
00:23:53
Um, as mentioned, we do have three employees that were nominated for this month, and I'll read them off.
00:23:56
Um, first and foremost we have raised Ross. Who?
00:24:03
His Spotlight nomination read.
00:24:07
A raise played a crucial role directly supporting the 2023 Globe in Miami Little League.
00:24:09
Reyes worked with Little League officials to identify repairs, maintenance and support needs to prepare the baseball complex for
00:24:15
the 2023 baseball season.

00:24:43
Yes, we just speech from this. Yeah. No, OK, just asking.
00:24:54
Next we have Larry Dooley, his nomination read.
00:25:02
UM Larry played a critical role in enabling the success of the courthouse electrical project. It was imperative that the
00:25:06
electrical project went to plan, ensuring the continuation of Heela County Board of Supervisors, courts, recorders, assessors,
00:25:11
treasurers.
00:25:16
Sheriff's and school Superintendent operations.
00:25:21
The process the project was a success due to Larry's direct support with logistics, communication and teamwork.
00:25:24
Larry built a Power Distribution hub and installed a 777 kilowatt generator, safeguarding servers and communication.
00:25:31
By providing emergent.
00:25:39
Power and cooling.
00:25:41
Once the project was completed, Larry worked with it, conducting inspections and reactivating communications.
00:25:42
Larry is also with facilities and has been with the county over 13 years. Larry.
00:25:49
You're welcome to give the speech as well.
00:26:01
Congratulations, Larry.
00:26:05
And next we have a John Desera.
00:26:08
John also directly supported the 2023 Globe and Miami Little League.
00:26:12
John Tyler tirelessly worked the baseball complex with field preparation, mowing, trash removal, watering, cleaning and conducting
00:26:16
repairs.
00:26:21
His efforts of preparing the baseball complex enabled the 2023 baseball season to kick off on schedule.
00:26:25
John's hard work ensured the baseball complex was in working order throughout the season, successfully enabling hundreds of
00:26:32
community members and youth to participate.
00:26:36
And again, ultimately facilitating 235 baseball games.
00:26:40
John is also with facilities and has been with the county over 13 years. John.
00:26:44
Thank you, guys. Congratulations. Thank you.
00:26:58
And that does conclude our spotlight sensation Erica. Thank you Supervisor Humphrey and comments.
00:27:01
No, just thank you for all you do. We appreciate it very much.
00:27:08
Supervisor Christiansen, thank you, Chairman. Thank you, Erica. And you know, it just goes to show we have the best employees.
00:27:12
I did want to share something though.
00:27:19
Because Reyes and John.
00:27:21
Told me that they get a really great support from the incarceration, the, the.
00:27:24
Prisoners.
00:27:31
That come and help and there's about four of them, they said.
00:27:32
And they do a fantastic job as well and I know we don't recognize them, but I just wanted to kind of do a shout out to say.
00:27:35
That that program.
00:27:43
Is beneficial to them and to us as well.
00:27:45
So thank you.
00:27:49
Thank you, guys. Good job. Thank you, Erica. Thank you.
00:27:51
Okay Honda 2C Presentation of March 31st.
00:27:55
23 through April 30th, 23 and May 31st 23 Helen County financial data as it compares to the Fiscal year 23 HeLa County budget.
00:27:59
And fiscal years 2020 2/21/20 and 19 year to date performance. Good morning Mayor.
00:28:09
It's OK we got them now.
00:28:21
Yeah.
00:28:22
Sorry about that. My my agenda quick and I were not apparently cooperating with each other.
00:28:38
So what each of you have are the past three months bar charts.
00:28:43
That will go in the budget book.
00:28:48
And those just show you and our constituents.
00:28:50
Where we were relative to budget and that month.
00:28:54
Targets.
00:28:59
There's nothing super interesting in them and I know you've been through several presentations already this morning, so.
00:29:01
I'm just going to give you the highlights for the month of May and then we'll be back.
00:29:07
Probably in September with an update on where we ended through the year.
00:29:13
So at the end of May 2023, which is 11 months into the fiscal year.
00:29:18
Our general fund revenues were 89% of the annual budget.
00:29:23
Which compares to 92% target.
00:29:27
And in total.
00:29:31
We were 1.6 million over the same time in 2022.
00:29:33
Of that 1.6 excise tax made-up almost half of it with $741,000 in additional excise tax.
00:29:39
And 18% of additional state shared sales tax.
00:29:48
For expenditures.
00:29:53
We were at 92% of the budget.
00:29:55
Including encumbrances compared to 92% year to date target, which is exactly where you want to be, we were $5 million higher than
00:29:59
the previous year.
00:30:03
Um, and of that 2.3 million was encumbrances.
00:30:08
And then?
00:30:14
Compared to the prior year, our salaries were salaries and benefits were about.
00:30:15
$4 million over the previous year.
00:30:21
And then we had a couple other line items that were a little higher. So that summaries right there on the front page.
00:30:23
Including a little bit of extra detail.
00:30:29
So that you.
00:30:32
As our supervisors and the public when we bring the budget book in a few months.
00:30:33
Um, so that that data is available and we're being transparent?
00:30:38
And so you, as the supervisors know, and so the general public knows, are.
00:30:42
Financial data is uploaded quarterly to the state transparency site.
00:30:46
And members of the public or members of staff or elected officials can go on that page.
00:30:51
And use the different tools to see what kind of graphs and stuff you get out of that. They're not as granular as what we give you
00:30:56
here for general funds, but they are transaction by transaction.
00:31:03
So anybody that wanted to see could go look at that.
00:31:10
Happy to answer any questions and happy to make sure I attach my attachments correctly next time.
00:31:13
Thank you, Mayor Supervisor Humphrey.
00:31:20
I have no questions. Thank you. Thank you, Supervisor Christensen. Thank you. Thank you, Mayor. No questions. Good job as usual.
00:31:22
Mayor, thank you so much for putting that together. Thank you to all the department heads and elected to make it possible to
00:31:26
present.
00:31:30
Data that.
00:31:34
Shows everybody's doing really well. Sure does. So thank you so much.
00:31:36
OK, we'll get on to #3 public hearings.
00:31:41
And we'll start with three AM information, discussion, action.
00:31:45
To consider a liquor license application counting number L-23-12.
00:31:50
Submitted by Monica Goodwin for the transfer of the Series 6 BAR license.
00:31:57
With an interim permit to operate at the Weekender.
00:32:02
At 1:20 rolls drive.
00:32:06
Located in Strawberry and issued a recommendation to the Arizona Department of Liquor Licenses.
00:32:09
And control whether the license should be granted.
00:32:15
Sam, you ready for this?
00:32:18
Just one second, I wanted to confirm something here really quick.
00:32:29
Yeah.
00:32:33
OK, as stated, this is a Series 12 restaurant liquor license application for the weekend or located in Strawberry.
00:32:42
The county does have an internal review process whereby the treasurer reviews the application and ensures that the applicant is
00:32:48
current on property tax payments for all properties owned in Hewitt County.
00:32:53
The health department and the building permitting department both review the application. To date, there have been issues reported
00:32:59
for the Weekender by the building permitting department relevant to that area of review, to which I'll ask Randy Plummer to
00:33:04
explain.
00:33:08
He come on up.
00:33:14
The Weekender.
00:33:17
We.
00:33:18
Good morning, Chairman. So the issue that we found on this one is.
00:33:20
It is the wrong address. This address is going to 105.
00:33:25
I believe Paul or.
00:33:31
Raleigh just 120 Rolls Drive and their structure is 7.
00:33:33
Something.
00:33:39
I can't remember the exact number but the.
00:33:40
They have had it at that Weekender and I think that number has been used in the past.
00:33:43
But during our review we saw that it had the wrong address.
00:33:49
The I believe the applicant stated that they called.
00:33:53
Liquor board.
00:33:58
It was. That was the number of heck that was out there when.
00:34:00
It first started.
00:34:02
But it's the wrong address, so we denied it on our part.
00:34:04
Wrong structure so.
00:34:09
They don't even own the property that when we did our research for that number.
00:34:11
OK.
00:34:17
Ready for questions? Certainly, Supervisor Humphrey.
00:34:19
Yeah, well.
00:34:24
Yeah, my question is, is the wrong address. Is the wrong address.
00:34:24
And, you know, applying for one in one place and having it at another. Great difficulties I would, I would think.
00:34:29
And if we passed it on to the.
00:34:36
State liquor board of the wrong address. I I don't know that I could support that.
00:34:39
Myself so.
00:34:45
No further questions, Supervisor Chris.
00:34:47
So one of the, if you Google search the 120 rolls versus the 7000 whatever and we did that this morning with Samantha, they're
00:34:49
like virtually the same spot.
00:34:55
Or are they not?
00:35:00
When I googled them with staff, we found an empty field and the structure.
00:35:02
Well, so we went on their Facebook page. We did the Google.
00:35:07
So the 1:05 or the 1/20 shows an empty field.
00:35:11
And then the seven.
00:35:15
I'm sorry, I don't know, but we went through their their Facebook page and Google Earth and it shows the actual building.
00:35:18
So they're kind of adjacent, are they? Even though the numbers are way far right, They they yes. And that street is not big. It's
00:35:27
not huge.
00:35:30
It could be, but the show two different owners.
00:35:34
So my only question would be.
00:35:37
What kind of legal jeopardy does that put us in if we?
00:35:39
Go ahead and pass this without that correction being made.
00:35:42
Chairman A member supervisors.
00:35:48
So just to so that the board understands, you are not passing anything, you're not approving the liquor license. What you're doing
00:35:49
is you're submitting a recommendation over to the liquor board who then makes the determination themselves. So your
00:35:54
recommendation?
00:35:59
Typically looks like something.
00:36:05
Yes, we would go ahead and submit a recommendation for the liquor board to approve this.
00:36:07
Here what you could do is.
00:36:13
So that that recommendation, but indicate that it's the wrong address.
00:36:15
OK.
00:36:20
Alright, that's.
00:36:21
Very helpful. Thank you. That's all I have.
00:36:23
So, Jessica, I mean, if if it's just a matter of wrong address, isn't that an easy fix correction?
00:36:26
If they have, I I'm not sure what the documentation looks like, but I'm assuming that the applicant is submitting A fiscal address
00:36:35
there or a physical address.
00:36:40
And you would have to clarify that what's pulling up on our books is something different.
00:36:46
So we may have a chance here in just a minute to ask that question. I'm just I guess I'm curious if if the owner just messed up on
00:36:52
the address and got the.
00:36:56
Whatever wrong, Herman is a owner there and I think in person.
00:37:01
She's there, yeah. I think she's at the podium when patient, so when I opened it up for.
00:37:06
I'm here.
00:37:10
Sure. OK. When you open up for public hearing, she can. Yeah. If you'll just hang on real tight, I'll have you.
00:37:11
Talk about here in a minute. I just. I just.
00:37:18
I'm just sitting here thinking if it's.
00:37:21
It's not at this address. It should be this one. It should be an easy fix I guess, my simple way. And that was kind of what staff
00:37:23
thought too, but.
00:37:27
Like said, we didn't want to approve something that had the wrong address. No, I'm. I'm glad you brought to our attention. I mean,
00:37:32
yeah, absolutely so.
00:37:35
You guys have anything else you want to come in or see?
00:37:40
I'm good, thank you. The only thing that I was concerned about because I have no objection to the to.
00:37:43
Approving.
00:37:48
But the uh that there would be no legal consequence.
00:37:49
Because it was posted at 1:20, but the actual address is not not actually right there, but.
00:37:54
I'm hearing from Jessica that we could make a motion that clarifies that in the motion.
00:38:02
I think Jerry District has got more to add. Yes, chairman, members, supervisors.
00:38:09
It's quite interesting. So there's no statutory authority.
00:38:13
Giving the board the ability to submit this recommendation to the Liquor Licensing Control Board. However, they are asking the
00:38:17
county for their input.
00:38:21
OK. I think we've been down this road in the past and the weekenders been there. I don't want to leave any.
00:38:26
Misconstrued that that that structure is fine. It's just some strong address, OK?
00:38:34
Ohh, are we good for you guys?
00:38:41
Alright, so at this time I'll open it up for public.
00:38:44
Comments and we'll start with you there and.
00:38:48
And pace and just let us know your name and.
00:38:50
Address all that.
00:38:53
Monica.
00:38:55
And.
00:38:57
Finish the reason why they've never redone it.
00:39:04
And because whoever did it back in the past.
00:39:07
Did that with the liquor board and with the liquor board. If you change, if you're just not transferring, if you change
00:39:10
everything, you have to go, You have to go through the whole process of reapplying and even just to transfer.
00:39:17
It takes.
00:39:24
Numerous months to do that, but to reapply.
00:39:25
For the address.
00:39:30
Takes a lot longer and we're just trying to get.
00:39:31
Everything kind of moving and everything and the names that it's supposed to be in.
00:39:35
That that address has been recognized through.
00:39:40
Google. It's recognized by the liquor board. It's recognized by Loopnet.
00:39:43
It is a different address, but they do they are the same.
00:39:48
For the Weekender.
00:39:53
OK.
00:39:55
Supervisor Humphrey, you have any questions for her?
00:39:58
Yeah, I guess I do so. So being that's been licensed under the wrong address.
00:40:03
We want to keep it licensed under the wrong address.
00:40:08
Is that is that what I'm hearing?
00:40:13
To make it to make it simpler.
00:40:15
Yeah, so the the is is the person that that.
00:40:17
Is the owner of this address aware?
00:40:21
And and and and and OK with the fact that he's got a liquor license on his property. That's not his property or his liquor
00:40:24
license.
00:40:28
Yeah.
00:40:33
OK. No more question. Welcome to North Arizona Supervisor Christensen. Yeah, thank you. I think I understand the predicament,
00:40:37
Monica.
00:40:42
So.
00:40:47
I really have no questions.
00:40:50
I really don't know what to ask at this point in time.
00:40:52
You know I I.
00:40:56
So how long is the weekend or been there? Monica, how long has this been going on?
00:40:59
A bear prior to that.
00:41:14
So we're talking back to.
00:41:15
I think this is been at least.
00:41:18
1015 years, I think. Maybe even longer than that, I don't know. And this, this chairman that goes way back. It used to be the
00:41:21
black bear and I've eaten there 40 years ago. I've eaten there, so.
00:41:26
So I guess you know what? I what I'm hearing is, is part of this, this deal is our fault as well. I see we missed it in the past.
00:41:32
No, no, no, not.
00:41:36
We we missed. We missed. We missed in the hat dress there on this. I see. Go ahead, Jessica.
00:41:40
The liquor board did.
00:41:47
Since we're not statutorily required to do whatever.
00:41:49
You're giving me a way out, aren't you, Jessica?
00:41:54
Got it. I got it.
00:41:57
Amazing. OK.
00:42:00
Is there anybody here in Globe have anything to say about anybody else impatient want to talk on it?
00:42:03
No one else.
00:42:10
Monica, thank you.
00:42:14
Thank you. And Cassie, is there anything on YouTube? I didn't think so.
00:42:16
OK.
00:42:21
So with that, I'll close the public public hearing and entertain a motion.
00:42:21
Mr. Chairman, I will recommend I will move to recommend that the Arizona Department of Liquor Licenses and Control.
00:42:26
Approved the liquor license application submitted by Monica Godwin or The Weekender, which is located on Walls Drive in
00:42:33
Strawberry.
00:42:38
Also, I can tell Mr. Chair.
00:42:45
Having a motion and second all in favor, do so by saying aye, aye.
00:42:48
Aye.
00:42:52
Motion passes.
00:42:53
OK.
00:42:57
Yeah, I did.
00:43:00
Yeah.
00:43:01
I did. Are you sleep?
00:43:02
OK, it's awful quiet over there.
00:43:04
All right, on to 3B Information, discussion Action to consider a liquor license applicant application.
00:43:07
Counting number L-23-13 submitted by Phoenix.
00:43:13
Starsky.
00:43:18
For a new Series 4 wholesaler license at Marlow Wines.
00:43:19
9634 W Fossil Creek Rd.
00:43:25
Located in Strawberry and issued a recommendation to the Arizona Department of Liquor Licenses.
00:43:28
And control where the license should be granted Sam.
00:43:34
Thank you, Chairman Ask stated. This is a Series 4 wholesaler liquor license application for Marlow Wines located in Strawberry.
00:43:39
The county does have an internal review process whereby the treasurer reviews the application and ensure the applicant is current
00:43:47
and property tax payments for all properties owned in.
00:43:51
New accounting.
00:43:56
The health department and building permitting department both review the application. To date, there have been issues reported
00:43:57
from Marla Wines both by the health department and the building permitting department relevant to their area of review, which I
00:44:02
asked that, Randy Plummer and Michael O'Driscoll explained.
00:44:07
Mona Penny.
00:44:14
Normally these are so easy.
00:44:16
So this one is in the middle of the neighborhood which is zoned R1.
00:44:19
And there are deed restrictions that say no businesses are allowed on this property.
00:44:24
Um, so during our review process?
00:44:29
With the home business like this.
00:44:32
And the serious forest allows for taste testing. And we've kind of.
00:44:35
Whether they do that or not, that is allowed under that series 4.
00:44:39
And that's not what's supposed to be going on in this neighborhood.
00:44:44
As the zoning.
00:44:49
And again, there were. We looked at options for them to move forward.
00:44:50
There are deed restrictions and say no businesses.
00:44:55
And the structure of the garage does not meet the requirements. This would be an S2.
00:44:58
Change in a garage is normally a you.
00:45:04
So there would be structural or not structural change, but there have to be.
00:45:07
Some reading.
00:45:11
Changes that could occur.
00:45:13
Or maybe be needed to to require depends on the.
00:45:15
Alcohol limit on a wines and wines can be.
00:45:19
Quite high in 10, some are fairly low so.
00:45:23
It would go into an S2 requirement as far as the building code would require.
00:45:26
OK, and did Michael did lesson from the health department?
00:45:32
Thank you, Chairman. Members of the Board and currently the Health department can't sign off on this liquor license because.
00:45:38
It's in a residential property.
00:45:45
And the board, or planning and zoning, hasn't voted.
00:45:47
To allow that type of business.
00:45:51
In a residential property.
00:45:53
But if that does come to fruition?
00:45:55
Then they would have to adhere to the FDA 2017 food code construction guidelines.
00:45:58
For any type of um.
00:46:04
Food product and the state health department does define a food product as a winery, brewery or distillery.
00:46:07
So that's where the health department stands right now.
00:46:14
OK. Thank you, Michael. Supervisor Humphrey questions, comments.
00:46:17
I don't have any question and my comments are is the it's you know the deed restrictions are against it.
00:46:24
Of buildings not suitable for commercial.
00:46:30
Health department doesn't support it.
00:46:33
That's my only comment.
00:46:35
Supervisor Christiansen, thank you. Thank you, Michael and Randy. So this is a, this is a interesting one.
00:46:37
Because.
00:46:45
We theoretically could approve.
00:46:46
The liquor license.
00:46:48
Knowing that the consequence of ever using that is extremely unlikely.
00:46:50
If you understand my comment, so we could approve the license, but he would not be able to use it because he's in a residential
00:46:57
area. He'd restrictions he'd have to apply for a CU P.
00:47:03
To do it.
00:47:08
Is that correct? Correct, Sir. And even if the liquor Commission in of Arizona?
00:47:09
Issues of liquor license they still would not be able to use their home until they go through the process of going through
00:47:15
planning and zoning, getting the deed restrictions lifted.
00:47:20
As well as dealing with the health department, so normally.
00:47:26
Would you do that first before you did this or correct anyway? It just seems out of order to me.
00:47:30
And even though I I encourage business and everything, it seems to be the wrong location.
00:47:38
For this type of business to me.
00:47:43
I don't know that the neighbors have had any input on this. They they.
00:47:46
Wouldn't have because there's been no CP applied for.
00:47:50
Correct, Sir. So part of the setup process is to reach out to the.
00:47:54
Neighboring properties within 300 feet.
00:47:59
Of this particular property and get their feedback whether they are for this or against this.
00:48:02
OK. And then we bring it in front of the Planning and Zoning Commission.
00:48:08
And after the Planning and Zoning Commission, we bring it in front of the board.
00:48:12
OK. I think I understand. Thank you. You've got your.
00:48:17
I don't think I have any questions or not I I all I, I well I would have one I guess is it coming up in front of planning and
00:48:21
zoning sometime in the future Randy or do you know?
00:48:26
Alright.
00:48:31
No application for CP is applied for at this. OK.
00:48:32
Alright, thanks guys.
00:48:36
With that, I'll open up to public hearing and paste in. I believe we have one. Go ahead and state your name and.
00:48:37
Where you're from and we'll go from there.
00:48:45
Hey, my name is Felix Depsky. I'm the owner of Mala Wines and I'm also the the resident of that spoken resident.
00:48:47
So we are a wine importer mainly.
00:48:55
And I am applying for a liquor license in order to sell wine to retailers.
00:48:58
How we do it? I I've never intended to do any kind of business out of my house.
00:49:03
The only reason why we did that is because of the first shipment that we received which was 2 pallets of wine which is around 800
00:49:08
bottles which I have currently stored in my garage and while we are resetting up our business operations.
00:49:15
But we have done so far we have.
00:49:23
Done by attempting said premises and we all are such sales are on premise so we go to retailers directly and then sample mine and
00:49:25
it said like if they would.
00:49:29
Place an order.
00:49:35
And we had lots of interest. So I'm already preparing my next shipment of wine, which is going to be way larger, which I can no
00:49:36
longer possibly store at my own property. So I'm already having an agreement with city storage in placement. They have a climate
00:49:41
controlled warehouse.
00:49:46
And this is the place where we're going to store all our merchandise.
00:49:52
So I never intend to do any kind of business at my property.
00:49:55
I I went to the I looked, talked to the zoning department and they said.
00:49:59
I would Ohh no actually I talked to Nicholas and they said if I wanna.
00:50:04
Change my whole address. I would have to reapply for the entire license, withdraw my current license, and that would probably
00:50:08
throw me back three to four months.
00:50:11
And.
00:50:16
So what I'm here to make my case that we as model wines are solely storing our first treatment at at my.
00:50:17
Property right now, but I'm already moving all my merchandise over to city storage and my subsequent shipping will also be stored
00:50:24
there. And it's a commercial area. It's way easier to to go in and out and I don't have to deal with anything at my own home.
00:50:30
The only reason why we did it at my home was to get started. You know, I didn't. I didn't know how the wine is going to.
00:50:37
Performance. A lot of people love it. So we are already preparing our next shipment and I didn't want to.
00:50:43
Pay for a warehouse that I wasn't using for many months, but now everything seems to be going on and we're already moving to a
00:50:48
warehouse, so that's my current situation here right now.
00:50:53
All right, Felix, thank you. Supervisor Humphrey, you have questions for Felix.
00:51:00
Just one.
00:51:07
So the the.
00:51:08
You're applied for liquor license for your home, correct?
00:51:09
I while I applied for medical license, I applied for my home because I I wasn't really aware that my business had my property is
00:51:14
business restricted.
00:51:19
And I just needed to have an address to apply for the Nikolai license. You know, because I didn't have a commercial address yet, I
00:51:24
didn't want to rent a warehouse.
00:51:29
For many months without having anything in there, so I thought might as well just use my own address.
00:51:33
Um.
00:51:39
Yeah.
00:51:40
But I never intended to do business out of my home. I never intend to do wine tastings at my home, and my wife would kill me if I
00:51:41
would do that. But I I I literally have it to store my first pallet there, and they are already moving out to a storage.
00:51:48
If, if I may ask, if you're not gonna do any business at your home and you're you're gonna move your storage to another place in
00:51:56
town?
00:52:01
Where are you going to do your business with the license that you're applying for?
00:52:06
Our business is solely on premise, so I go to so it will be at your home.
00:52:11
No, no, on premise at the at the retailers premise. So I go to the valley, I go to wine bars, I go to restaurants, I go there by
00:52:17
myself person to person and then I'll sample the wine and if they like it, they put an order in and then I personally delivered
00:52:23
the wine. So literally it's just sitting in a storage, I go into the storage, take the cap the the boxes out and drive to the
00:52:29
retailer.
00:52:35
OK. No, no further questions, Mr. Chair.
00:52:44
Other than I, I've been to the.
00:52:49
Liquor board before to try to go against some of the like because if you get a license, you get the license.
00:52:52
And whatever comes with the license, it doesn't specify storage, it doesn't specify anything.
00:52:59
And so I've been to Arizona, the liquor board, to try to put restrictions on a license for certain things.
00:53:05
And and it was a real difficult deal. Hmm. And so in in in this case.
00:53:12
I feel it would be difficult.
00:53:21
Umm.
00:53:23
Or.
00:53:25
For a license for a residential area.
00:53:27
That that's against the deed restriction.
00:53:30
I'll get to you in a minute, James. Go ahead, Steve.
00:53:34
Mr. Stepanski, thank you for the information sounds like you're having.
00:53:38
A diminishing need to have it.
00:53:44
At your home.
00:53:47
But my question really is not to you, it's to either Randy or.
00:53:49
Umm.
00:53:54
Michael.
00:53:56
Is Mr. Stepanski.
00:53:58
Allowed right now with no changes of.
00:54:00
Or in conditions from community development to simply store wine in his garage.
00:54:04
And then eventually move it to another location. Is that allowed?
00:54:12
It is not allowed to have a business operation.
00:54:25
At his current address.
00:54:29
It is garage.
00:54:32
Now.
00:54:33
I'll leave it at that. Is it considered a business?
00:54:36
To have.
00:54:40
A pass through his garage on the product.
00:54:42
Would I come to someone's house and say if they have a bottle of wine? If that's a business, no. But they have submitted for the
00:54:46
liquor license.
00:54:50
And and put this down as the business address.
00:54:54
So we would consider this a a business.
00:54:57
That he has stated that he is running.
00:55:01
You was taking the wine and and doing his taste testing and trying to sell it.
00:55:03
This is a business.
00:55:08
Currently.
00:55:10
Yeah, he reapplies for a liquor license at another.
00:55:11
Location.
00:55:14
That would allow for it, but it has some wine in his garage.
00:55:15
Ohh is he in violation?
00:55:20
Of the code.
00:55:22
Currently the.
00:55:24
He just admitted that he has one in his garage right now.
00:55:26
So is that a vague area?
00:55:31
Well.
00:55:34
He could turn around and you know currently what has stated that his violation.
00:55:36
He says he is running the business and he is taking the first shipment and it started in in his garage.
00:55:42
So that is a violation of his deed restrictions.
00:55:48
And of the zoning.
00:55:51
Again when I come out and if you had a pile of wine in your garage that you were consuming.
00:55:54
Is that a violation? No.
00:55:59
But.
00:56:01
Per the applicant and trying to get a liquor license for that address.
00:56:02
Yes, that is a violation.
00:56:07
OK.
00:56:09
I just wanted to be clear on that. So I think Mr. Stefanski's looking maybe for some direction and that would be to continue
00:56:11
seeking a different location and he may need to apply for another location.
00:56:17
Due to the fact that it makes it very difficult for us.
00:56:24
To approve something that's not going to work.
00:56:28
Once he applies for a CU P.
00:56:33
Right. And it sounds like he's found another warehouse.
00:56:35
Right. That may be totally compliant. It's impatient. So really probably is not us.
00:56:39
At that moment, then, it would be the town of Patient.
00:56:44
They would go out and inspect to make sure that that.
00:56:46
Businesses allowed there.
00:56:50
Umm.
00:56:52
So if that address was changed to there.
00:56:53
I don't believe it would even be in front of you. Well, and I know of another person's good friend that was in the wine wholesale
00:56:56
business.
00:57:00
Lived in Elk Ridge. OK in Payson.
00:57:05
Ohh and could not operate.
00:57:10
Her business to her home, even though it was simply storage.
00:57:12
So that's why I'm asking that specific question and again there there's.
00:57:17
Alcohol content in wines.
00:57:23
I went through this several times. Is is a pretty packed big difference.
00:57:26
And 15% is the.
00:57:30
Kind of the threshold number.
00:57:32
And if you're under 15%, which a lot of wines are, but there's a lot of wines that are over that, that requires a whole nother
00:57:34
risk level as far as building goes.
00:57:39
OK.
00:57:44
Thank you, Randy.
00:57:45
James is covering something you wanna say. Michael, I just I had a question that first comments are made.
00:57:47
Hi, Mr. Stefansky, that he had held.
00:57:55
Wine tasting at his home or at his business location that he's at my home. I have. I had wine tastings.
00:58:00
At the retailers premise, so I'm going to retailers.
00:58:07
And I'm just simply sampling. I haven't sold a single bottle of wine. You know, I'm not allowed to sell any wine. I'm I'm, I have
00:58:11
a federal permit, a federal permit from the TTB which allows me to import.
00:58:17
And distribute wine.
00:58:23
And I'm allowed to hold a samplings and solicit orders.
00:58:24
And that's all we have done, but never at our own premise. We always went to the restaurants and through the wine bar.
00:58:30
Good, James.
00:58:37
I think he gets down to the fact that it's just not his own. It's not in the ordinance to do this and I think.
00:58:40
Mr.
00:58:45
Felix, there's gonna.
00:58:47
And don't need to reapply.
00:58:48
For sounds to me.
00:58:50
Jessica There's no other way around that, is there? I mean.
00:58:52
Chairman, Member supervisors. I'm not sure if it would be helpful for him.
00:58:57
To have you guys submit a recommendation for approval for the other address.
00:59:01
And.
00:59:06
Doesn't seem like it would be sufficient for the liquor board, because they do require applicants to start the whole process over
00:59:08
once there's a change of address.
00:59:12
Yeah, and.
00:59:18
But put me back probably four or five months of time.
00:59:19
Yeah, and that's unfortunate. I I think it's just that our hands are gonna be tight on this one, but let's see where it goes.
00:59:24
Is anybody else in pacing that wants to speak of this?
00:59:30
No.
00:59:35
No one in love. No one on YouTube. I'll close the public hearing.
00:59:37
And.
00:59:42
You too ready?
00:59:44
And then a motion.
00:59:47
Mr. I moved to not recommend that the Arizona Department of Liquor Licensing Control approved.
00:59:49
The liquor license application submitted by Monica Goodwin.
00:59:55
For the weekend.
01:00:00
No, no, no. Wrong one. OK. I'm sorry. Yeah, wrong. Yeah. OK. I hang on.
01:00:02
Are you wanting to submit a recommendation to the liquor board that you want them to not approve it? Or are you wanting to not
01:00:08
submit a recommendation at all?
01:00:12
Mr. Chair, I moved to not make a recommendation at all.
01:00:19
I will second that having a motion and a second.
01:00:27
On favor, do so by saying aye, aye, aye.
01:00:30
Aye, motion carries.
01:00:34
Alright.
01:00:36
Onto regular agenda items #4.
01:00:37
For a information discussion action to approve the intergovernmental agreement between the HeLa County Recorders Office.
01:00:42
The Healer County Division of Elect Elections and the PACE and Unified School District.
01:00:49
To provide election services through December 31st, 26.
01:00:55
With one year automatic renewals thereafter. Eric, good morning. Good morning, Chairman, Finance, Supervisor Christensen,
01:01:00
Supervisor Humphrey and this is just an approval that internal agreement for Election Services. First up on the list is the PACE
01:01:05
and Unified School District. We back in the future with Miami Unified School District and others as we come up and we renew these
01:01:10
contracts.
01:01:15
That's just the verbiage change that was required and so that's what we're here for today.
01:01:20
OK. Thank you, Eric, Supervisor Humphrey.
01:01:25
I have no questions, Supervisor Christensen. No questions. I'm good, Eric. Thank you, Sir, that I entertain a motion, Mr. Chair.
01:01:28
I'll move to approve the intergovernmental agreement between the Heela County Recorder's Office and the HeLa County Division of
01:01:32
Elections.
01:01:37
And the Paceman Unified School District.
01:01:41
To provide election services as presented.
01:01:44
I'll second that having a motion and a second all in favor. Do so by saying aye, aye, aye, aye. Motion carries. Thank you, Eric.
01:01:48
Thank you. Supervisors 4B information discussion, action.
01:01:53
To approve the use of the State of Arizona Contract Agreement number Ctr. 059323.
01:01:59
With Santan Ford Partners LLC in the amount of.
01:02:07
$528,891.36.
01:02:12
For the purchase of 6 new 24 Ford Expedition 4 door 4x4 SUV's as outlined in the specifications.
01:02:17
To be utilized as patrol vehicles for the Helix County Sheriff's Office and Homer. Good morning, Sir. Good morning, Chairman and
01:02:27
board members.
01:02:31
The agenda item we've talked about this before is for the board to consider approving the purchase of 6 new Ford Expeditions to
01:02:37
use as patrol vehicles for the Heater County Sheriff's Department.
01:02:42
Earlier this year, we shared a presentation for you with the, they're 60 patrol vehicles that we have. We have 24 of them older
01:02:47
than 10 years and we're trying to continue to modernize our fleet and this is an effort to do that.
01:02:52
The order window has opened and recently and we would like to use the same contract to purchase the six six Expeditions.
01:02:59
The cost for the six new expeditions as specified and outfitted.
01:03:06
Is $528,891.36.
01:03:10
The source of funding is 500,000 from ARPA and the remainder from General Fund.
01:03:15
So with that, I'll interesting questions and request your approval. Thank you, Homer.
01:03:20
Supervisor Humphrey, I have no questions. Mr. Supervisor Christensen, thank you, Homero, No questions.
01:03:25
You know, when I read this agenda item I I thought that's kind of think back in the past I thought we'd already approved this as
01:03:32
soon as the windows was open to go ahead and do it because that's been the hold up on a lot of our fleet.
01:03:38
It's just the process of the opportunity to to.
01:03:44
Place orders we had already and we wasted no time bringing it to you. And perhaps that may have been the case. I don't, I don't
01:03:47
know exactly, but we're here, I think in a very prompt action.
01:03:52
Yeah. OK. Well, thanks for updating us on this and we'll vote on it again if need be, so that.
01:03:58
James, you're good.
01:04:05
And entertain a motion as long as this isn't times 2.
01:04:08
Oh my God, you you can put that in your motion.
01:04:12
Chris, Chairman. I'll just say that there was a, it was a approved for 500,000. OK, and this is.
01:04:17
They the actual bids came in $28,000 more and so this is because it's 28,000 more to get that approval, OK.
01:04:23
So I just wanted to be sure it wasn't friends too. Mr. Chair. I move to approve the youth.
01:04:32
On the State of Arizona Contract Agreement number Ctr. 0593.
01:04:37
2-3 with Santan Ford Partners, LLC.
01:04:42
In the amount of $528,891.36.
01:04:45
I will, Sir, as presented. I will second that having a motion in a second. All in favor, do so by saying aye, aye, aye, aye.
01:04:52
Motion carries. Thank you. Thank you, Homer.
01:04:57
Undersea Information Discussion Action to Authorize Advertisement of Invitation for bids number 071023.
01:05:02
The Gazella Roadway improvement project on. Good morning, Good morning, Mr. Chairman, board members.
01:05:10
This is a request to advertise an invitation for bids number 071023.
01:05:16
Garcia Rd. Roadway Improvements Project.
01:05:24
A little bit of background. The proposed work is on Garcinia Road.
01:05:28
For approximately 1.7 miles.
01:05:33
From the roadway high point to the Tunnel Creek.
01:05:36
Shores intersection.
01:05:40
The improvements consist of milling the existing chip seal.
01:05:42
Compacting the milled material in place.
01:05:46
And placing a double chip seal.
01:05:50
With a fog coat on top of the compacted material.
01:05:53
Additional work includes widening 3 curves.
01:05:58
To improve visibility, visibility, and drivability.
01:06:01
And then new striping will also be placed on the chip seal.
01:06:05
What's an engineering and survey?
01:06:10
Have prepared plans, specifications and a project estimate.
01:06:12
The project is budgeted to be funded from the Half Cent Transportation Excise Fund.
01:06:17
So Garcia Rd. is A2 lane roadway.
01:06:25
With it had an average annual daily traffic of 596 vehicles and that was in 2022.
01:06:28
And it's classified as a major collector.
01:06:35
It provides access to the communities of Gisela.
01:06:38
And the town on National Forest.
01:06:43
This section of roadway has deteriorated.
01:06:46
And shows signs of cracking, rutting, potholes.
01:06:50
And other surface defects.
01:06:54
The primary objective of the project is to.
01:06:57
Improve the driving surface and improve.
01:07:01
Driving ability.
01:07:03
Of the three curves by widening them.
01:07:05
On both the inside and outside of the curves.
01:07:08
In conclusion, the project will improve drivability on this section of Garcia Rd.
01:07:10
By widening those 3 curves and then milling.
01:07:17
And doing a new double chip seal.
01:07:20
On top of the old material.
01:07:22
The Public Works Director recommends that the Board of Supervisors approve the advertisement for invitation for bids.
01:07:27
071023
01:07:34
for the Guy Sea Level Rd. Roadway Improvement Project.
01:07:37
I'll be happy to answer any questions. Thank you, Tom. Supervisor Humphrey.
01:07:41
I have no questions other than thank you very much for getting this up.
01:07:45
Because I I believe it was supposed to be done about a year or so ago and so I I'm, I'm.
01:07:50
I'm grateful that you have.
01:07:56
Found it and found the funding.
01:07:58
And I also appreciate the fact that you're widening some of those curves.
01:08:01
Because on the first part going in.
01:08:04
With a with a long gooseneck trailer, you can't make some of those turns without taking up the complete Rd. So nothing other than
01:08:07
thank you very much.
01:08:11
Supervisor efficiency. Thank you, Chairman. Thank you, Tom. Yeah, we need to keep our roads maintained. Looks like a good project.
01:08:17
I remember when all this was dirt, so.
01:08:22
That was bad.
01:08:27
So thanks. Thank you.
01:08:28
Tom, how, how long will this be out for bids? It'll be out there about 30 days, about 30 days and so.
01:08:31
So we will be able to get to work on this this year.
01:08:40
Yes, Sir. Our our goal is to finish it this year right on. Thank you.
01:08:43
So with that again motion, Mr. Chair moved to authorize the advertisement of invitation for bid number 071023.
01:08:48
Mr. Chair, I will second that having a motion in a second. All in favor, do so by saying aye, aye, aye, aye. Motion carries. Thank
01:08:58
you, Tom.
01:09:02
On to the information discussion Action to approve Amendment #1.
01:09:06
To contract number 051122 Dash Bulk, Fuel and Lubricant with Synergy Petroleum LLC to extend the term of the contract for one
01:09:11
additional year.
01:09:18
From July 19th 23 to July 18th 24.
01:09:25
For the purchase of bulk fuel and lubricants for a not to exceed the amount of 1,200,000.
01:09:29
Hotmail.
01:09:36
Thank you.
01:09:38
Back in July of 22nd of 2022, the board approved a contract.
01:09:40
05/11/22 for bulk fuel and and lubricants.
01:09:45
It was for a one year term but it allowed for 333 annual renewals.
01:09:49
We would like to renew this contract for the first time using amendment number one to to this contract.
01:09:55
And continue to.
01:10:02
Use the prices that were offered to us on the competitive bidding that took place in 2022.
01:10:05
And and the way that competitive bidding, the prices are established is using.
01:10:10
A commodity price for fuels?
01:10:14
It's a nationwide information system.
01:10:17
Available to all Opus.
01:10:20
And it publishes a weekly numbers for the price of fuel on a regional basis.
01:10:22
And so when they deliver fuel to our various locations in the county, all the road yards, if the price is based on that location
01:10:26
and based on the on the weekly price that is generated by that commodity index.
01:10:33
So it's something that we can renew and and and feel good that we're enjoying the benefit of the competitive bidding that we that
01:10:39
we undertook last year.
01:10:43
The dollar amount that $1.2 million is similar as the last year, the first year.
01:10:48
And we think that there will be sufficient to cover our fuel cost for this year. And with that I will entertain questions or.
01:10:54
Ask for your approval. Thank you, Homer. Supervisor Humphrey, Mr. Chair, I have no question. Supervisor Christensen. Thank you,
01:11:02
Homero. Is that money her money then?
01:11:06
Hurt money? Yes. OK, thanks.
01:11:11
Thank you, Homero, that I'd entertain a motion.
01:11:14
Mr. Chair, I move to approve amendment number one to contract, number 051122.
01:11:17
With.
01:11:23
Synergy Petroleum is present. I will second.
01:11:25
Having a motion and a second all in favor. Do so by saying aye aye aye motion carries on the E INFORMATION Discussion action.
01:11:28
To approve collection agreement number 070623.
01:11:37
But the Arizona Game and Fish Department with a not to exceed amount of.
01:11:42
$284,674 to provide environmental monitoring during the remaining construction of the Tunnel Creek Bridge. Thank you.
01:11:46
So this is a request for approval of collection agreement number 070623.
01:11:57
Between Hill County and the Arizona Game and Fish Department.
01:12:04
For the environmental monitoring on the Tunnel Creek Bridge construction project.
01:12:08
So a little bit of background. On December 28th, 2021, the US Fish and Wildlife Service.
01:12:14
Issued the ballot biological opinion.
01:12:21
For the Tonal Creek Bridge project.
01:12:25
One requirement of the biological opinion is that.
01:12:27
A qualified and certified biologist.
01:12:31
Shall monitor the project.
01:12:35
To avoid incidental take of Northern Mexican Garter Snakes Yellow Billed Cuckoos.
01:12:38
And Southwestern Willow flycatchers.
01:12:44
On August 15th, 2022, Wheeler County entered into an initial collection agreement number 072522.
01:12:48
With the Arizona Game and Fish Department.
01:12:58
That agreement expired on July 30th, 2023.
01:13:01
And as I mentioned, the Arizona Game and Fish Department.
01:13:07
Is providing an assigned biologist.
01:13:10
To monitor the project on a daily basis, he has to be there prior to the start of work.
01:13:13
He has to look under all the vehicles before any vehicles are moved and he has to remain there throughout the entire day until all
01:13:19
work is finished.
01:13:23
So yeah, the evaluation is again, the US Fish and Wildlife Service has required that qualified and certified biologists monitored
01:13:29
the project.
01:13:33
In Arizona, Game and Fish is doing that for us.
01:13:38
And again, it's for the Mexican Garter snake.
01:13:42
Yellow Bill Cuckoo and the Southwestern Willow Flycatcher.
01:13:45
So Arizona Game and Fish has provided this requirement since the project started.
01:13:50
August 15th, 2022.
01:13:56
This.
01:13:59
Is a.
01:14:00
But request for a new agreement.
01:14:01
That will be in effect.
01:14:04
From.
01:14:06
July 6th, 2023 to May 25th, 2024.
01:14:08
And this agreement will be in the amount of 284,000.
01:14:14
$674
01:14:18
So it is the recommendation of the public Works Director.
01:14:22
And Heather County Public Works Department.
01:14:25
That we enter into this collection agreement with the Arizona Game and Fish Department to continue.
01:14:28
Their environmental monitoring during the.
01:14:34
Remainder of the construction of the Tunnel Creek Bridge project.
01:14:37
And with that, I'll be happy to answer any questions. Thank you, Tom. Supervisor Humphrey.
01:14:41
I have no questions.
01:14:46
Supervisor Christensen, I have a question, Tom.
01:14:49
Is this part of the original bid that we did or is this on top of it addition to it?
01:14:52
Because I know we agreed to have this.
01:14:58
Done.
01:15:02
But.
01:15:04
We already agreed to do it, this is just a update.
01:15:06
In the contract, correct. So it's kind of complicated in the in our agreement with Arizona Department of Transportation who's
01:15:09
administering the project.
01:15:13
We have set a set aside $175,000.
01:15:18
For the.
01:15:23
For this monitoring requirement.
01:15:25
So so far we've only used.
01:15:28
We've only paid 2 invoices.
01:15:30
2 Arizona Game and Fish totaling 61,625 dollars.
01:15:33
So we still have.
01:15:38
So you could take the 175,000 minus the 61?
01:15:40
We have that remainder.
01:15:44
Before.
01:15:46
We would have to come up with additional funds so that so there is a remainder in the current contract that we have.
01:15:47
With a dot and a.
01:15:55
What we do is we send the invoices to a dot.
01:15:56
They.
01:15:59
Hate Arizona Game and Fish for us?
01:16:00
Once we hit that.
01:16:03
Once we run out of the 175,000.
01:16:06
Then we would have to.
01:16:09
Get into these new funds. The only thing this agreement is doing is.
01:16:11
Establishing the new agreement because the old one expired and the rates did go up.
01:16:15
About 5 to 10% on some of the some of the items.
01:16:20
OK.
01:16:25
Alright. Thanks Tom.
01:16:26
Thank you, Tom.
01:16:27
Entertain a motion.
01:16:29
Mr. Chair, I'll move to approve their Arizona again, the Fish Department Collection Agreement number 070623, and the amount of
01:16:31
$284,674 as presented.
01:16:37
Mr. Chair, I'll second that function having a motion in a second. All in favor, do so by saying aye. Aye, aye. Motion carries.
01:16:43
Thank you, Tom. Thank you.
01:16:47
Onto F Information Discussion Action to adopt Resolution #23-08-01.
01:16:52
Supporting a grant application to the HeLa River Indian Community.
01:17:01
For the Christopher Coles Fire District and authorizing HeLa County to act as a fiscal agent.
01:17:05
And except they Gaming Grant award to Christopher Cole Fire District in the Mount of.
01:17:12
$235,000 for the purchase of a new Type 6 brush truck.
01:17:18
And we have Marin here and a wreck, Conley Camp Basin I believe. So that would be the battalion there he is OK Christopher Cole.
01:17:23
Hi, Mr. Chairman, members of the Board and I'm right now with Christopher Fire District and thank you for having me here.
01:17:36
Today I'm here on behalf of Fire Chief Robert Lockhart. He was unable to attend, unfortunately.
01:17:41
He he was successful in writing a grant to the Healer River Indian Community.
01:17:47
And I believe it was for the amount of $255,000 for a a Type 6 brush truck for our district.
01:17:52
One of the requirements of the grants, as you had stated previously, is.
01:18:00
The grant money has to go through the county before we can receive it.
01:18:04
And I believe that the Human River Indian community has to have a signed resolution prior to August 17th.
01:18:07
OK. Thank you, Sir. Yes, Sir.
01:18:15
You're good with that, Mary. That's it. Any questions? Care of it separated, Humphrey.
01:18:19
Just one, did you say that the that the truck was, the amount of the truck was how much?
01:18:25
I believe that they are. Grant was for a total of 255,000.
01:18:32
OK, because I have in front of me 235,000.
01:18:37
And of its 255,000, I'm just wondering where the other 20,000 was coming from?
01:18:42
If you don't mind, let me check your e-mail real quick and I can verify verify that, Yeah, no that that. That's fine. I just.
01:18:47
I just trying to.
01:18:53
Save confusion if we approve a grant and it's.
01:18:55
Short of of the amount.
01:18:58
See if there's an amount on.
01:19:02
Yeah, it it may very well be. Thank you.
01:19:05
It doesn't 55, so we have a typo in the agenda item.
01:19:08
So we'll need to change the requested resolution to be 255,000.
01:19:12
Is that OK with the Healer River Indian community?
01:19:23
Community that would just change it to 1.
01:19:26
Well, this is the application. That was OK. Well, then in March, yeah, I'm looking at what's in front of me.
01:19:29
On their approach to their approval, say 235, OK, sorry.
01:19:38
OK. So the 2:35 is correct. OK. I'm sorry.
01:19:45
So we looked at the wrong attention. May not be correct.
01:19:48
And maybe maybe correct. It may not be correct.
01:19:50
I think this would go around all day. If you're good, how? Supervisor Christensen, how about you? I have no questions. Thank you.
01:19:55
I'm. I told him either.
01:20:00
So with that, I'll entertain a motion.
01:20:05
Well, I I guess I've got a question before I give you motion. Is is where's the other 20 coming from? No, it's Sam. You won't
01:20:10
repeat what you just said. I'm gonna go.
01:20:15
Yeah.
01:20:21
Yes, they requested 200 and 35255 thousand, but the tribe only awarded them 235,000. That's all they're getting. 235 is it? Yeah.
01:20:22
OK, then I guess they're gonna get it.
01:20:34
Discount on the truck, or the hope so up with 1000 of constituent funds or something. So District 1.
01:20:36
I just don't. I'll make, yeah, I just.
01:20:46
Approving a grant for a different amount than what it what I OK.
01:20:50
There it is.
01:21:06
OK.
01:21:11
OK, I'll make a motion.
01:21:13
Umm.
01:21:18
Mr. Chair, I moved to adopt resolution #23-08.
01:21:19
Dash one as presented. I will second that.
01:21:23
Having a motion and second all in favor, do so by saying aye, aye.
01:21:27
Aye, motion carries.
01:21:32
Thank you. Thank you, man. Thank you, thank you.
01:21:34
Auntie G Information Discussion Action to Approve an intergovernmental agreement.
01:21:38
Between the City of Apache Junction and Heela County Community Services.
01:21:44
Housing Department to receive Community Development Block Grant allocations through central Arizona governments.
01:21:49
For FY24 to HeLa County and FY25 to the city Kylie.
01:21:57
Mr. Chairman, members of the board, good morning.
01:22:04
This is a request for your approval so that we can share the Community Development Block Grant funding with the City of Apache
01:22:06
Junction.
01:22:10
This has come about because the funding amounts that we're getting continue to.
01:22:15
The lower each year, and so they've allowed us to combine funds with the city of Apache Junction in order to.
01:22:20
Really make an impact for developing viable communities, providing decent housing, suitable living environments for our
01:22:28
communities. So there is no matching requirement and we're looking at approximately $130,000 give or take combined.
01:22:36
OK.
01:22:46
Supervisor Humphrey, I have no question.
01:22:47
Supervisor Christian, thank you, Kaylee. No questions.
01:22:49
Is, is this something we've done in the past? Yes, there's. So this is the second year that we're doing this combined with the
01:22:53
city. So we actually did get.
01:22:57
This is 2 years in a row that the county has had the funds, so next year it will be on the city of Apache Junction.
01:23:02
OK. We'll be back on schedule for alternating. Thank you. Yes, Sir, that I'd entertain a motion. Mr. Chair, I move to approve the
01:23:08
intergovernmental agreement between the HeLa County.
01:23:13
In the city of Apache Junction that's presented.
01:23:18
Ohh, second that Mr. Chair having a motion in a second all in favor do so by saying aye, aye aye aye Motion carries.
01:23:22
Onto each information discussion Action to approve Amendment #9 to an intergovernmental agreement contract number D IT0 Dash
01:23:29
002263.
01:23:35
Between the Arizona Department of Economic Security and the Heela County Community Services Department to include the total value
01:23:41
of the itemized service budget.
01:23:45
Of $396,219 to be used as rent and utility assistance.
01:23:51
For the period of July 1st 23 through June 30th 24.
01:23:57
Philly, you're it again. Yes, Sir. Chairman, Members of the Board, this.
01:24:02
IGA first came about in 2020, so this is amendment number 9/4.
01:24:07
Like you said, utility and rental assistance just shy of $400,000 and this funding also has no matching requirement and it comes
01:24:14
from the Department of Economic Security.
01:24:19
Thank you, Supervisor Humphrey.
01:24:24
Just one in Renton Utilities is the rent is is, is that for for like people that need rental assistance or is part of that would
01:24:27
part of that be for temporary housing for homeless?
01:24:33
So this is specific to rental? OK, we have other grants that are specific to homelessness.
01:24:39
Um, this actually is. The acronym is TANAFF, Temporary Assistance for Needy Families. So you have to have children under 18 in the
01:24:45
household to qualify for that specific OK out of money.
01:24:52
Thank you.
01:24:58
Supervisor Christians, thank you. Chairman, No, I have no question.
01:25:00
I'm good as well, so with that I'd entertain a motion.
01:25:03
Mr. Chair, I move to approve amendment.
01:25:06
#9 to the.

As presented.
01:25:24
I will second having a motion. Second all in favor do so by saying aye, aye, aye, motion carries.
01:25:25
Onto our information discussion action to approve funding agreement number.
01:25:31
203-24 between Arizona Department of Housing and HeLa County Community Services Department.
01:25:36
Housing services to use Local Low Income Home Energy Assistance Program and Department of Energy Weatherization Readiness Fund in
01:25:43
the amount of.
01:25:48
$218,482 for the period of July 1st 23 through June 30th 24. Kaylee.
01:25:54
Mr. Chairman, members of the Board, this is another grant that we get every year for whether it's weatherization assistance.
01:26:03
UM primarily used to reduce fuel and electricity expenses for our clients, while also improving the health and safety in their
01:26:10
homes.
01:26:15
Like you mentioned, it comes from the Department of Energy and this also has matching requirement.
01:26:21
OK. Thank you, Supervisor Humphrey.
01:26:27
Are you having any luck with local contractors?
01:26:30
Some.
01:26:33
Some of the requirements are are a bit stringent but we are we are having some luck.
01:26:34
And they're like BP I certified I.
01:26:39
Certified with the state to do weatherization.
01:26:42
OK. Thank you, Supervisor Christiansen. Thank you, Kaylee. No questions. I'm good as well. So that I'd entertain him.
01:26:45
Motion.
01:26:52
Mr. Chairman to Approve Arizona Department of Housing Funding Agreement #203-24 in the amount of $218,482 as presented.
01:26:53
I'll second that Mr. Chair having a motion, and second all in favor, do so by saying aye, aye, aye, aye. Motion carries.
01:27:04
Your last one, Kaylee Jay Information, discussion, action to authorize the HeLa County.
01:27:12
Community Services Services department to submit a grant application.
01:27:17
To the Water Infrastructure Finance Authority of Arizona in the amount of $250,000 for a clean water project titled Countrywide
01:27:23
Cesspool Elimination Project for the period of two years.
01:27:29
We got two of you. So who's doing this? Michael, I'll, I'll do this one, OK.
01:27:37
So it's a joint.
01:27:42
Effort between the health department, environmental Health department and community services. So this is a unique opportunity
01:27:44
that.
01:27:48
HeLa County has working with WIFA to get funds available.
01:27:52
For homeowners that meet the income qualifications if they live in a cesspool, to get their cesspool eliminated and get a brand
01:27:57
new septic system for that property paid for.
01:28:03
And this is the grant application that Kaylee and Josh have been working on with WIFA.
01:28:09
Which allows that for HeLa County. So we would be sort of the test case in Arizona and Heela County. It's a great program.
01:28:15
In in the body of the agenda, you see it's a loan forgiveness.
01:28:23
Don't let that fool you. This is they're gonna pay the contractors directly.
01:28:28
To get the work done for homeowners. So this is a great possible option for homeowners to eliminate their cesspools if they have
01:28:33
issues with it.
01:28:37
And also to protect the groundwater that we have in, in HeLa County. And so it's for two years, $250,000 a year.
01:28:42
And it's a test case in Arizona to see if this program is is going to work good.
01:28:52
Supervisor Humphrey.
01:28:58
Well, I one, I think it's a great program to qualify the only qualified.
01:29:00
Think that you need to participate in this.
01:29:05
Is to have a cesspool.
01:29:09
Assess pool and there's going to be an income qualification, income, income as well, yes, correct.
01:29:11
OK.
01:29:17
Yeah, I I just hope that some of our properties are available because some of them may not have room for Leech and all those
01:29:20
things, but.
01:29:24
Because that can grow and so then they gotta do a perk test prior to.
01:29:28
So that's included as well so.
01:29:32
Umm.
01:29:35
I hope it's a I hope. I hope a lot of the money is able to go to help people with cesspools.
01:29:36
Instead of perk testing things that don't show up or people that don't have room so.
01:29:41
Thank you very much for putting in for this and and I I hope it works for the people.
01:29:46
Thank you Sir. Supervisor Christians to take Chairman Yeah, we need to get all the money we can get to fix accessible problems.
01:29:52
So.
01:29:56
This is not related at all to the discussion we've been having about Porta. John's right. I mean, it does not provide money to
01:30:00
remedy septic systems that are acts or anything like that, right? This is something else. OK. Thank you.
01:30:08
So Michael, what happens if you're in the Tri-City Sanitation District?
01:30:18
So currently tri-cities is their plan is to move forward with construction in about a year if they find a location that's been
01:30:21
approved for their wastewater treatment plant.
01:30:27
So currently what we would do for this is hold off on the Tri-City area for a first year until we find out whether they're going
01:30:32
to move forward with construction.
01:30:37
In the future, if the construction doesn't come through, then those people in the Tri-City sanitary District area would be
01:30:42
eligible as well. OK, And so what's the income level?
01:30:48
Ohh I think guys about.
01:30:54
Requirement of 59,321.
01:30:57
OK. That's that. Yeah or less. OK.
01:31:01
Had to get program sounds like a really good deal, so.
01:31:04
Any more questions?
01:31:09
They're good other than, Yeah, that that was that was. I'm glad you brought that up because.
01:31:11
That would be under qualification so.
01:31:16
If I get asked, it's like you're in a Tri-City district. Hold on. Because you know, well, The thing is, is if that's gonna go
01:31:18
through, yeah, we'll just be throwing money out there for Ohh, you know? Yeah, I agree. I agree. But then again, a motion.
01:31:25
Mr. Chair, I moved to authorize the HeLa County Community Service Department to submit a grant application.
01:31:32

01:36:36
OK, on. I'm just gonna.
01:36:43
Let you all know what we're doing on in at 1:30 this afternoon.
01:36:46
Which we may have to reconvene for.
01:36:51
There will be an auction.
01:36:53
To conduct A to conduct an auction.
01:36:55
For the cell of 1260 square footage of assessors, parcel number 206.
01:36:58
Dash 10-076.
01:37:05
Homer, I guess you'll be ready for that when it comes up so.
01:37:08
Yes, ma'am.
01:37:11
Member supervisors. I just want to note for the public that the bids will be accepted at 12:45 to 1:15.
01:37:13
12:45 to 1:15, correct? That is on the public notice. OK, we'll be conducted at 1:30 where you're making the determination, but
01:37:22
those beginning bids are going to be accepted from 12:45 to 1:15.
01:37:28
Ohh now.
01:37:36
Correct. OK. So anyone out there listening, you can put your bid in at 12:45 to 1:15. You have 30 minutes to place the bid.
01:37:38
Which will be sealed beards I would imagine, right? Is that right?
01:37:46
Are they sealed?
01:37:51
You can put your option your hat on. Is that what you're saying now?
01:38:00
I I have a question go right ahead. So this is this is property owned by the county.
01:38:04
That we're auctioning off.
01:38:11
OK, I have been in situations lately where I have.
01:38:13
Talked about selling county property and it had to at least be sold for 90% of the appraised value.
01:38:18
So if this auction does not bring 90% of the appraised value.
01:38:27
Of this property, Will that property still be sold?
01:38:34
No.
01:38:39
Chairman, member state advisor. So the minimal acceptable bid is $1520.00. So that is 90% of their praise value. OK, yeah, I just
01:38:40
had to bring that up because I've had difficulties with county property and what we can sell it for and what we can't sell it for.
01:38:47
And I would just be sure we're on the same page with all of them. That's it.
01:38:54
So.
01:39:02
Tell me that number again so people hear it.
01:39:03
Jessica is 1500 and 120.
01:39:06
1520 dollars is the minimum bid or the starting bid price, correct? The appraised value was $1688. OK, cool.
01:39:09
Well, hopefully we have love.
01:39:19
Lot of interest from 1:30.
01:39:21
But.
01:39:24
Just one. So you wanted just one. All right. We're omaro thank you for that. We'll we'll look for you 130 on the #5.
01:39:24
The do you, either one of you, have anything you want to address on the consented action that items?
01:39:37
Ohh no Sir, I'm, I'm good.
01:39:45
I only have a comment. It's impressive that it's from A-Z.
01:39:48
Yeah, that that impresses me.
01:39:54
One more sound you'd have been scrambling for letters.
01:39:57
Alright, I'll take a motion to.
01:40:02
Except these.
01:40:05
Mr. Chair, I move to approve consent agenda items 5A through five. ZI will 2nd every motion and second all in favor. Do so by
01:40:07

01:40:30
We'll give you about 3 minutes and hear what you have to say.

The gentleman blocking the easement, she said, well, you can't do that. He says you need to contact a community development and
01:42:25
have them go out, investigate if there's a violation of the blockage, decide them and make them open it.
01:42:32
And I said well that's that sounds good, so.
01:42:39
Later on that same day I I contacted another neighbor that lives just next door to the gentleman that blocked the easement.
01:42:44
Here Connie and Louie Bernard.
01:42:53
Kindly call me. We've already been there and we spoke to code enforcement specialist there, Tiffany.
01:42:57
Bronco.
01:43:03
Brown.
01:43:05
Call Croft.
01:43:07
And she told us that there was nothing that she could do to force him to open the easement here.
01:43:08
When I called up and spoke to Melissa again and Melissa said let me call in the development and and find out and I'll call you
01:43:16
back.
01:43:21
Melissa called me back and she said there's an event there and if he's got it blocked.
01:43:27
Since it's not a county, maintained.
01:43:33
Easement. There was nothing that they could do to force maybe they development.
01:43:36
To do that, to have that easement open back up again.
01:43:42
That is the only way, the 2nd way in and out of our neighborhood.
01:43:47
The only exit and entry point that we have ingress and egress is.
01:43:54
On German Ranch Rd.
01:43:59
The other actions that we had is the one that was blocked, the easement that was blocked here.
01:44:00
If there's a a situation where we can't use the the one entry and exit there, we're stuck. We can't go South, we can't go anywhere
01:44:07
even we need that easement open.
01:44:13
Umm.
01:44:19
I called the.
01:44:22
When I told Melissa that she had, Tiffany called them.
01:44:23
And Tiffany explained to me that.
01:44:28
Since it was not a county maintained easement, there was nothing that she could do.
01:44:31
To get him to open up that easement, she gave me several.
01:44:36
Fairs honor revised statutes, but to thank for easement.
01:44:41
And I looked them up.
01:44:45
And read them and and there's nothing in those ARS statutes, Arizona by statute that said there has to be a county maintained
01:44:49
easement on enforcement to be to take place.
01:44:55
I also.
01:45:01
Review the.
01:45:04
Pilot counties or minor land division ordinance.
01:45:06
Sections are 100.01 and 02. This is establishes easement.
01:45:10
There's nothing in there also that says it has to be a county maintained easement.
01:45:15
Also look at the HeLa County.
01:45:19
Planning and zoning ordinances sections 107.1 and 107.2 and they talked about violations in closing the easements here.
01:45:22
And it doesn't show you anything about having to be accounting maintained.
01:45:32
We need that easement open. I don't know why. The only recourse that they said that we had was to go to Superior Court.
01:45:37
And present this to the judge and have the judge issue an order opening the easement.
01:45:46
Cuba County doesn't have any.
01:45:53
Thing that says it has to be a a.
01:45:56
A county maintained engagement.
01:45:59
And also Arizona revised statute that doesn't say anything about counties having to have maintained the easement.
01:46:03
And.
01:46:12
I asked also Tiffany this I should since German Ranch Rd.
01:46:14
The only other entrance is all an easement.
01:46:19
Owned by the people who live on on the.
01:46:23
Each side of the screen.
01:46:26
Should I try to if anyone of those people that live there land owners decided to block these but.
01:46:27
She says what would be the outcome, it says, since it's not a maintained easement too.
01:46:33
The guy that blocked the the easement here that you were using before, he's been using that easement to get back and forth through
01:46:38
his house across German Ranch Rd.
01:46:43
He would have to open up his house and take you to court to get you to open up the easement. So that's where we're at here,
01:46:48
that's.
01:46:52
I think Connie Marie wants to show you a few things here.
01:46:58
Yeah, we are the owners of Parcel 1.
01:47:03
Ohh, go ahead. Yes, can you state your name and and address as well?
01:47:07
Yeah.
01:47:13
I am planning.
01:47:14
Years of Do you want our home address or the parcel one in Parcel 2?
01:47:18
You want those addresses?
01:47:25
Just your regular address is fine.
01:47:27
OK, we live in Chandler 871 N Los Altos.
01:47:30
Chandler, AZ.
01:47:37
We bought parcels 1.
01:47:40
12, almost 13 years ago.
01:47:43
And when we bought it we got this documentation.
01:47:47
From the title company.
01:47:51
We then bought Parcel 2.
01:47:54
And with that parcel.
01:47:57
We got this documentation again.
01:47:59
They said our legal way in and out was really through Elk Rd.
01:48:02
We do have a child, a son in a wheelchair that doesn't walk.
01:48:10
Or talk.
01:48:16
We bought this property to and let him enjoy because we cannot travel.
01:48:17
If it is snowing.
01:48:24
And we are up there visiting and it starts to snow. We cannot get up Fossil Creek Rd. With his wheelchair van.
01:48:27
Because it goes uphill.
01:48:37
We we always gone through Elk Rd. ever since we've owned the premises.
01:48:40
Parcel 3.
01:48:49
The woman there was supposed to be here. She's.
01:48:51
Raised a lot of concern about this too, because she's lived there since 1990 and has never been able has always used Elk Road to
01:48:54
go to her premises.
01:49:00
So we're all very concerned we can no longer walk our son.
01:49:08
We can no longer get out in case of an emergency.
01:49:13
And.
01:49:17
If our son if we call 911 and fossil German ranch Rd. is blocked.
01:49:18
There's no other way for them to get in with him closing off that easement.
01:49:25
In the beginning, he told us he was going to put up a fence and give us a key.
01:49:31
And we thought, OK, we will wait. But may of this year when we came out, we noticed he had it totally wired off.
01:49:36
And he had planted grass.
01:49:45
Which means.
01:49:49
He his intention was to totally close it off.
01:49:50
Um, I'm just asking that.
01:49:54
The community or does something to help U.S. Open this.
01:49:57
Easement.
01:50:02
It was documented in 1995, but it has been used.
01:50:04
For over 40 years that he's been.
01:50:09
OK.
01:50:16
Is there anyone else who wants to speak to this?
01:50:19
Yeah.
01:50:22
There's appointments and in meetings, but this is.
01:50:27
Also harming, I mean we could get a petition.
01:50:31
A lot of people that have always walked through there.
01:50:35
To go to.
01:50:39
Type in the back area.
01:50:42
Now they can't even do it. They ask us what's going on and we explained to them.
01:50:45
We are. We talked to the owner of the property that who blocked the easement there.
01:50:52
His name is Albert Sin.
01:50:59
And he refuses to open up, to take down the fence, and he says no, I'm I'm closing it up.
01:51:01
We also call the it's been about a month ago, we called the sheriff and explain the situation and the sheriff and the sheriff
01:51:09
says, well, I can go talk to him, he says. But to me it's it's it's a civil matter. I can't force them to to open up the easement.
01:51:16
The sheriff did go over to talk to him and then Mr. Clean refused to open up the easement.
01:51:24
So here we are.
01:51:29
OK. Thank you.
01:51:32
So.
01:51:35
Supervisor Christianson, this is your district. It is I'm. I'm looking at a map trying to figure out where we are here. So.
01:51:36
Ohh, there's situations in that area where these are problematic, so.
01:51:43
They're looking for a remedy. So I'm just going to ask our staff, what is the remedy for them? Is the remedy through the county?
01:51:48
Is the remedy through lawsuits? Is the. I mean.
01:51:53
Are we at all?
01:52:00
Something that can act on this, the board or not.
01:52:04
Jessica Chairman number Supervisors.
01:52:08
Today this was a call to the public, so it was on the agenda. So what the board has with for you to do is to respond to criticism.
01:52:11
Instruct staff to look into it or request that the matter be put on a future agenda.
01:52:19
OK, then my comments would be that we in order to seek a remedy.
01:52:25
Because it is a public comment that we would, I'm gonna ask staff to look into this.
01:52:30
And come up with an answer.
01:52:35
That we can provide for you.
01:52:37
Christian.
01:52:41
Yes, Sir. Go ahead James. I do have a question. This has been described to me as a utility easement.
01:52:41
Is that in fact truth that it is a utility easement?
01:52:49
That were killed.
01:52:53
It's like.
01:52:57
And utility easement.
01:52:58
He all the above.
01:53:03
Public private utility, yeah.
01:53:06
You know, this isn't just a nice lady issue. I actually have one of these issues in my district.
01:53:09
And.
01:53:13
Quite honestly, it is going to civil matter. That's where it's headed and so.
01:53:15
You know, and I think as time goes on and more properties are sold and changed and whatnot, it's going to be, it's going to be
01:53:20
more but.
01:53:23
So thank you for thank you for your your presentation and bringing this up to us and.
01:53:27
And Supervisor Christiansen has instructed the our folks to look into it some more and.
01:53:33
Hopefully you'll be hearing back from us fairly soon.
01:53:39
OK. Can I?
01:53:42
Yeah.
01:53:44
Yep.
01:53:51
Just getting quick claim deed. He did not get title insurance. He did not go through a title agency so.
01:53:57
I'm wondering if that's part of the problem. It's already gone through all four.
01:54:05
People signing the document and it's being recorded. It's not like it's just an easement that's being used and not recorded.
01:54:13
I just want to point that out. Understood. Thank you.
01:54:21
OK. Thank you. Anyone else in Payson or we're good?
01:54:25
I think we're.
01:54:33
OK. Anything on YouTube?
01:54:34
How many?
01:54:36
25.
01:54:41
Alright, good deal. Anyone. And no one in Globe and sorta.
01:54:42
We'll move on to #7 for updates. James, do you have any updates?
01:54:46
1st.
01:54:51
Mr. I'll just mention that the Local 1st is holding their rural policy form.
01:54:51
Here in gold Miami this week. So Wednesday, Thursday, Friday, having.
01:54:58
A bunch of people from all over the state coming into town.
01:55:03
And enjoying.
01:55:06
Tomorrow afternoon there's a.
01:55:08
A tour economic development tour.
01:55:11
It'll go on, see the things that are going on and.
01:55:13
In the community.
01:55:16
And then when Thursday and Friday you have sessions.
01:55:17
Economic development and other things that will first.
01:55:21
Aye.
01:55:24
Supports.
01:55:25
So that's a good thing for us.
01:55:26
Thank you, James.
01:55:28
Supervisor Humphrey.
01:55:29
Just first of the month meetings, I got a tunnel basin meeting tonight at 5:00.
01:55:33
And then next week.
01:55:37
Roosevelt on the radio, So.
01:55:40
Just just meetings.
01:55:43
To deal with public meetings.
01:55:44
Good deal, Supervisor Christensen. I think it's Chairman a week from today, August 8th.
01:55:46
I'm gonna be holding a town hall meeting in Pine at the Pine Community Center.
01:55:53
It'll be from 9:00 to 12:00. I've been invited several of our.
01:55:58
Of department heads and others to be there to represent the various departments of the county and also our departments and things
01:56:02
like that. So we hope to have a good crowd and.
01:56:07
Were there to answer questions, we're there to just make some brief presentations on what we're doing in HeLa County in general
01:56:13
and also in that district, so.
01:56:19
I look forward to doing that.
01:56:25
Good deal.
01:56:26
So I don't have a whole lot. Next week I got a Arizona Conservation and RCD meeting and.
01:56:28
They're not kind of slow, so I'm enjoying it.
01:56:34
And we'll move on to #8.
01:56:38
Executive Session 8A Information Discussion Action.
01:56:42
To vote to go into Executive Session for Senator ARS 38431.03 A 3.
01:56:48
For discussions with representatives from Heela County Provisional Community College District.
01:56:55
GCP CCD.
01:57:01
And to obtain consultation for legal advice regarding how the county wants to move forward.
01:57:03
With GCC and or their educational partner and authorize its attorneys.
01:57:11
To proceed as discussed in executive session, so I'll entertain a motion.
01:57:17
So move, Chairman.
01:57:22
And seconded.
01:57:24
All in favor? Aye. Motion carries. We'll be back.
01:57:25
Sometime.
01:57:30
You got everybody will stick together and all.
