On May 9th, 2023, the Hill County Board of Supervisors directed staff to begin the process to vacate a portion of Olive St. 00:12:43
Staff provided notifications and public postings of the board decision. 00:12:53
That is an action that you took in the past. 00:12:58
And that action was was taken because we had an application from someone for a road abandonment. 00:13:01
Or a property encroached on on the on the roadway. 00:13:07
And as you'll hear, that roadway had never been constructed, built or used. 00:13:12
And we will explain all of that as as we move with this board item. So the plan of the townsite of West Globe was recorded in 00:13:17
1910. Some of the roads and alleys in the subdivision have never been constructed or completed. 00:13:24
And many have been vacated in the past. This portion of Olive St. has never been built. 00:13:31
The only a budding owner, the Lavado Family Trust, for this portion of our street that had joined their property has submitted a 00:13:37
bid. 00:13:40
The bid meets the minimum requirement established by the current HeLa County policy on abandonment. 00:13:44
Of roadways and Heela County. 00:13:49
Abandoning this portion of Olive St. will not deny anyone access through any of their properties. 00:13:52
In accordance with the Arizona Revised Statute 287202. 00:13:57
This portion of roadway is not necessary for the public use as a roadway. 00:14:02
The trust is an abutting owner to the subject property. 00:14:07
An application was signed by one of the trustees of the trust in each Lovato and indicating the trust would like to purchase the 00:14:10
property. 00:14:14
There are two different definitions of a budding owners. 00:14:17
That apply to the water abandonment process and notice is required to be given to each category of a budding owners. 00:14:20
The first category of a budding owners is the definition and common. 00:14:27
Usage, which is the current owners of land with a common border that adjoined that portion of the highway, proposed to be 00:14:32
abandoned. 00:14:35
Uh is a Rs 286701. 00:14:39
Grant the Board of Supervisors authority to abandon a public highway or a portion of a Polk highway, and to do so by Rep 00:14:43
resolution, provided that at least 60 days before the resolution is effective. 00:14:48
The Board of Supervisors. 00:14:54
Gets noticed by certified mail to the owners of the land and putting the highway or portion of the highway to be abandoned. 00:14:56
And that board shall matter. 00:15:02
Shall not abandon the highway or portion of the highway unless the majority of the owners of land abutting the highway approve. 00:15:05
The action to abandon the highway. 00:15:11
Notice has been sent through the Lotto Trust. 00:15:14

And the notice was also served sent by certified mail. 00:15:20
The trust is the only owner of land abutting the portion of Olive St. proposed to be abandoned. 00:15:25
And staff believes that the trust approves the abandonment as indicated. 00:15:31
By a signed application on their part. OK The second category of a budding owner is a specialized definition and and quoting. ARS 00:15:36

For purposes of this section, abutting owners means the original owner of the vacated roadway or the original owners air. 00:15:47
Who have previously had a portion of the property acquired for roadway purposes. 00:15:54
And therefore are left within a budding remainder of property or which they still retain direct ownership. 00:15:59

The value based on current assessed values of the trust is $915 as shown on the attachments. 00:17:39
The Trust has submitted $1000 for the purchase. The board would accept that higher amount if they choose to by deviating from that 00:17:46
from that minimum policy. 00:17:50
It is the in conclusion it is the best interest of all involved to abandon. 00:17:56

Jeffrey and Denise Lovato, the trustees of the trust, submitted a check to Public Works Department in the amount of $1000. 00:18:01
For like version of Olive St. adjacent to their property, it's the recommendation of public Works director that the board accepted 00:18:07

more people if we had a larger facility and that is our goal. Being a nonprofit, we know that responsibility of funding this 00:23:37

You know, does fall on our shoulders and we're doing the best we can since the last time we spoke, we did receive a $400,000 00:23:48

I'm contingent on the fact that we actually get a shovel in the ground and a permit. 00:23:56

On May 9th, 2023, the Hill County Board of Supervisors directed staff to begin the process to vacate a portion of Olive St. 00:12:43
Staff provided notifications and public postings of the board decision. 00:12:53
That is an action that you took in the past. 00:12:58
And that action was was taken because we had an application from someone for a road abandonment. 00:13:01
Or a property encroached on on the on the roadway. 00:13:07
And as you'll hear, that roadway had never been constructed, built or used. 00:13:12
And we will explain all of that as as we move with this board item. So the plan of the townsite of West Globe was recorded in 00:13:17
1910. Some of the roads and alleys in the subdivision have never been constructed or completed. 00:13:24
And many have been vacated in the past. This portion of Olive St. has never been built. 00:13:31
The only a budding owner, the Lavado Family Trust, for this portion of our street that had joined their property has submitted a 00:13:37
bid. 00:13:40
The bid meets the minimum requirement established by the current HeLa County policy on abandonment. 00:13:44
Of roadways and Heela County. 00:13:49
Abandoning this portion of Olive St. will not deny anyone access through any of their properties. 00:13:52
In accordance with the Arizona Revised Statute 287202. 00:13:57
This portion of roadway is not necessary for the public use as a roadway. 00:14:02
The trust is an abutting owner to the subject property. 00:14:07
An application was signed by one of the trustees of the trust in each Lovato and indicating the trust would like to purchase the 00:14:10
property. 00:14:14
There are two different definitions of a budding owners. 00:14:17
That apply to the water abandonment process and notice is required to be given to each category of a budding owners. 00:14:20
The first category of a budding owners is the definition and common. 00:14:27
Usage, which is the current owners of land with a common border that adjoined that portion of the highway, proposed to be 00:14:32
abandoned. 00:14:35
Uh is a Rs 286701. 00:14:39
Grant the Board of Supervisors authority to abandon a public highway or a portion of a Polk highway, and to do so by Rep 00:14:43
resolution, provided that at least 60 days before the resolution is effective. 00:14:48
The Board of Supervisors. 00:14:54
Gets noticed by certified mail to the owners of the land and putting the highway or portion of the highway to be abandoned. 00:14:56
And that board shall matter. 00:15:02
Shall not abandon the highway or portion of the highway unless the majority of the owners of land abutting the highway approve. 00:15:05
The action to abandon the highway. 00:15:11
Notice has been sent through the Lotto Trust. 00:15:14

The trust is the only owner of land abutting the portion of Olive St. proposed to be abandoned. 00:15:25

They came in and spent the night there, left the next morning we were able to sit down with them and kind of critique the site for 00:39:07
