Thank you Chairman and Board Members. In August of 2023, the Assessors Title, Examiner and GIS Department received a recorded 00:00:42
warranty deed. 00:00:45
For the transfer of 104 properties to Mr. David Lamar Berry, upon examination of the legal description of that deed, it was 00:00:49
discovered that the legal description or parcel 103, the transfer portion of parcel 20615014 B, had previously been conveyed to 00:00:58
Joe Sanchez on a 1979 warranty deed and that change was not reflected in the assessors records. 00:01:07
The assessor's office sent a notice of proposed correction to Mr. David Berry and Mr. Joe Sanchez. 00:01:16
To split the parcel, Mr. Sanchez consented to the change. However, Mr. Barry did not. 00:01:23
A notice of proposed correction real property for partial 20615014 C was sent to the assessor's office. However, an agreement was 00:01:31
not reached. Therefore Mr. Berry chose to be heard. 00:01:38

On December 15th, 2023, Hearing Officer Johnson held a Board of Equalization hearing regarding a correction the Assessors Office 00:01:50

After hearing testimony from Mr. Berry and the assessor's office, respectively, Hearing Officer Johnson upheld the correction for 00:02:02

Part of the contractual agreement between Mr. Johnson and the board, the boards review of hearing officers decision is limited. 00:02:12
The county receives the decision of the hearing officer and shall uphold the decision of the hearing officer unless there is 00:02:19
substantiated evidence presented to the Board of Equalization. 00:02:24
That the procedures for the hearing were not followed, state law was violated, or there's no evidence from the record to 00:02:30
