Overnight Lane, Malachite Lane and Pork W Drive For decades. We can go back as far as we want to and we see that we've been | 00:08:40 | |
maintaining these roads. This was a subdivision that was created. The roads were actually created before 1960. We actually see an | 00:08:47 | |
aerial map that shows us the roads. | 00:08:54 | |
And we, like I said earlier, we've been maintaining the roads, but now that we have purchased the roads just right now you | 00:09:03 | |

cultural and recreational gatherings. By providing mobile ADA compliant seating, this initiative will enhance community | 00:13:15 | |

While stimulating simultaneously boosting local economic economic activity through increased attendance at events and associated | 00:13:29 | |

This is 2 portable ADA compliant grandstands that can be moved throughout the county and there I don't comprehend it all but it's | 00:13:38 | |
old. You can go put them in place park them and push 1 button and they establish set themselves up. Open up to full grandstands | 00:13:47 | |
that have 88 ramps and and seating and be a total of just less than 400 seats that can be used. | 00:13:57 | |
And they will have a canopy on top as well. | 00:14:07 | |
Covered seating these right now out at the fairgrounds we have the second rodeo arena have no stands at all can be used there. | 00:14:10 | |
And we'd like to be able to use them for other events throughout the county and throughout the community. Freeport has their | 00:14:20 | |
community investment fund that they do annually and appropriate dollars for investments. And we, the county applied for this. | 00:14:30 | |
The idea is that report has approved a funding request of 125,965 which will pay for one of those grand standing. The county will | 00:14:41 | |

So it's 100% match between the two of us, but it would be a great opportunity for us to enhance recreational opportunities in the | 00:14:53 | |

With unpaid taxes were real property taxes aren't paid by the owner. And then there are. Depending on the nature of the property, | 00:20:51 | |
there are at least three mechanisms by which. | 00:20:57 | |
Taxes can be collected. | 00:21:05 | |
Resolution number 241202 deals with the narrow cases where property is actually needed to the state of Arizona under the state | 00:21:08 | |
under a tax deed and then the clerk of the Board of Supervisors schedules sales of those properties. The other mechanisms involve | 00:21:18 | |
pretty much the treasurer and in some cases the the Department of Revenue. This one is deals with the. | 00:21:28 | |
With the Board of Supervisors and the clerk of the board. | 00:21:38 | |
And after the sale is made. | 00:21:42 | |
And taxes are paid and distributed to the various tax entities and top of those taxes. On occasion there are excess proceeds | 00:21:47 | |
remaining and very often the treasurer's office is unable to determine where the owner is so that the that the excess proceeds can | 00:21:55 | |
return be returned to the property owner. I surveyed other counties. | 00:22:04 | |
And many of the smaller counties, like Gila, use what's called in this treatment process, whereby after a period of time, after | 00:22:13 | |
two years, if the property owner cannot be located either in Arizona or at the last known mailing address of the property owner, | 00:22:21 | |
then that property is transferred to the Arizona Department of Revenue under a process known as achievement. It basically goes | 00:22:28 | |
back to English common law, and then that property is held. | 00:22:35 | |
By the Department of Revenue available for the person to put the property owner. | 00:22:43 | |
Being properly identified to claim those excess proceeds and so this. | 00:22:49 | |
This resolution deals with that narrow subject matter and. | 00:22:56 | |
I first started working on this this past summer when Samantha was dealing with the. | 00:23:03 | |
With an issue that took some time to resolve but finally was and so the other counties use this mechanism successfully. And so | 00:23:08 | |
this board is being asked to consider adopting Resolution 24 Dash 1202 that deals with that limited set of of properties that are | 00:23:15 | |
needed to the state under tax fee. | 00:23:22 | |

in Title 42 requires that excess proceeds be returned to the property owner. That's very specifically required. | 00:24:41 | |

And, and the, the mechanism that's established in this resolution protects both the due process rights and the property interest | 00:24:52 | |
rights, constitutional rights both under both the federal and Arizona State constitutions to return to their property that they're | 00:24:59 | |

That's the way the legislature dealt with the matter. They could have dealt with it differently, but that's mechanism that that | 00:25:12 | |
we're probably going to follow. So, so this that you're proposing, so if you have money left over on this, this sale, you know, | 00:25:19 | |
you pay the back taxes there, say $1000 left, whatever it is. And it goes into this, this account basically that you're proposing | 00:25:27 | |
under this resolution, he'll sit there for two years and then if it's not claimed. | 00:25:34 | |
Comes back to the county or no? It sits in the treasurer's office for two years. Well, the treasurer attempts to locate the owner | 00:25:42 | |
and return the the excess. Proceeds to the property owner. In the event after two years, she the tracer is unable to return those | 00:25:51 | |
funds and the property is transferred by the achievement process to the Arizona Department of Revenue. | 00:25:59 | |
And the Department of Revenue holds that money and if the proper claim is made? | 00:26:08 | |
Then that person can receive their their money from the Department of Revenue. | 00:26:14 | |
And almost every state in the union has adopted a process like that. You can look now and you can check for yourself to see if you | 00:26:20 | |
own any property. If you have a small bank account in just kind of abandoned it 8 or 10 years ago and you had $40 in it, you still | 00:26:28 | |
have $40 in it after the statutory fees are collected. | 00:26:36 | |
From that, but that money belongs to the property owner and never to the state or the political subdivisions of the state. | 00:26:45 | |

Bochy up asked me to to head the project to. | 00:53:10 | |
Develop a new agreement with the city of Globe, which actually went very smoothly. | 00:53:18 | |
But there are some changes coming up in the City of Gold was very cooperative Mr. Jepsen was in in getting this thing done. And if | 00:53:25 | |
the board looks in your agenda packet, the agreement has already been executed by the Gulf City Council and signed by by the | 00:53:31 | |

And as importantly, the the city attorney was instrumental in in getting this draft to resolution and make some changes in the way | 00:53:46 | |
that the two courts will operate. Historically, my whole lifetime, those courts have been Co located. But to begin the process we | 00:53:53 | |

The model intergovernmental agreement provided by the Arizona Supreme Court, the administrative office of the court is a guide and | 00:54:08 | |

developed the the cost sharing portion of the intergovernmental agreement whereby. | 00:54:24 | |
The City of Gold will pay for some of the occupancy in the the current Justice Court. | 00:54:33 | |

And so we will be contracting for the for with the justice court and to do that, take care of those low level cases, the civil and | 00:56:47 | |
the criminal. And, but, but the, the big difference is our window at the City Hall will stay open and people will still be able to | 00:56:54 | |
just pull up, walk over and take care of those civil cases there. And that's the biggest change. So it's important that we keep | 00:57:02 | |

That's where the funding would come from this and then with the county staff, we've come up with about four or five different | 00:58:32 | |
options. We haven't settled on what option if we were to. | 00:58:40 | |
Church what we would use it for, but we certainly could use the space for county services in multiple different ways. Or even one | 00:58:47 | |
of the options was possibly using it as a teen center down in the southern area. Here it could be used as a training Center for | 00:58:56 | |
staff moving in smaller departments. We certainly could use it for an IT and a facility's drop down area. | 00:59:05 | |
Since anytime we travel back and forth for services for IT facilities, we have to go all the way back to the other side of town | 00:59:14 | |
and back so we could certainly use it a portion of this. The total square footage of the building is about 7500 square feet. The | 00:59:22 | |
top and bottom are identical of 3700 square feet each plus some change. | 00:59:29 | |
It's an open spot, the 37 on the top level. The bottom level is split up into eight different offices. And it still has some items | 00:59:37 | |

in coordination with the Fiery County Fire Chief's Association, distributed to the fire district so that they have them available | 01:06:18 | |

From a Miss Bianca Airline, the event coordinator for Gila County. These letters are a notice of trespass which will be enforced | 01:37:24 | |
for two years. This letter does not have any Healy County marking seal. | 01:37:32 | |

funeral that's coming up next month, we won't be able to attend. | 01:40:57 | |
And #4 and mostly important to us is destiny. Charter school holds, holds their 8th grade graduation there. And that means | 01:41:05 | |

And so before my conclusion, since I have a couple more seconds, we did during the fair fiasco, we did try to reach out to Miss | 01:41:21 | |

And taxes are paid and distributed to the various tax entities and top of those taxes. On occasion there are excess proceeds | 00:21:47 | |

return be returned to the property owner. I surveyed other counties. | 00:22:04 | |
And many of the smaller counties, like Gila, use what's called in this treatment process, whereby after a period of time, after | 00:22:13 | |
two years, if the property owner cannot be located either in Arizona or at the last known mailing address of the property owner, | 00:22:21 | |
then that property is transferred to the Arizona Department of Revenue under a process known as achievement. It basically goes | 00:22:28 | |
back to English common law, and then that property is held. | 00:22:35 | |
By the Department of Revenue available for the person to put the property owner. | 00:22:43 | |

Bochy up asked me to to head the project to. | 00:53:10 | |
Develop a new agreement with the city of Globe, which actually went very smoothly. | 00:53:18 | |
But there are some changes coming up in the City of Gold was very cooperative Mr. Jepsen was in in getting this thing done. And if | 00:53:25 | |
the board looks in your agenda packet, the agreement has already been executed by the Gulf City Council and signed by by the | 00:53:31 | |

Church what we would use it for, but we certainly could use the space for county services in multiple different ways. Or even one | 00:58:47 | |
of the options was possibly using it as a teen center down in the southern area. Here it could be used as a training Center for | 00:58:56 | |

Umm, we didn't want to cause any further scene and our kids still had the whole fair to. | 01:39:37 | |
To show their animals, yeah, they had a lot of participation in for the rest of the week, so we didn't want to cause any trouble. | 01:39:47 | |

But that if that is the reason, it definitely doesn't constitute trespassing. | 01:39:55 | |
So now if this trespass stands, there are serious life events that will be missed out on #1 Clayton and I will no longer be able | 01:40:04 | |

In good standings with the cooperative ext #2 my girls will no longer be able to participate in any 4H or fair activities. They | 01:40:19 | |

funeral that's coming up next month, we won't be able to attend. | 01:40:57 | |
And #4 and mostly important to us is destiny. Charter school holds, holds their 8th grade graduation there. And that means | 01:41:05 | |
