Either in person or on the phone. 00:00:00
And we have one. 00:00:04
Declaration that we are going to be discussing and that's item. 00:00:07
1A. 00:00:11
It's information discussion, action to adopt resolution #25. 00:00:12
04. 00:00:19
Issuing a declaration of emergency due to flooding. 00:00:21
When the rain storms in the city of Globe. 00:00:24
Town of Miami. 00:00:27
Play pool unincorporated Gulick County. 00:00:28
And the San Carlos Apache reservation. 00:00:31
It authorizes the chairman of the board provides. 00:00:34
Take all further actions. 00:00:37
As may be necessary or appropriate. 00:00:39
To implement this declaration of pursuant to Arizona Revised Statute. 00:00:42
26. 00:00:47
311. 00:00:48
Michael, do you have a presentation? 00:00:50
Yes Sir, I do a very brief 1. 00:00:54
Thank you, Chairman, members of the board. 00:00:57
So you may wonder why this? 00:00:59
Declaration is needed. 00:01:01
And the board voted. 00:01:03
On a declaration. 00:01:04
For September 27th. On the storms that hit September 25th. 00:01:06
And what I can say is. 00:01:12
These were two. 00:01:15
Separate flooding events. 00:01:17
And and rain cells. 00:01:18
And if we were to move forward with the possibility of. 00:01:20
Getting some. 00:01:25
Federal money back. 00:01:26
From FEMA for this. 00:01:28
Event uh. 00:01:30
Since they happened. 00:01:31
48 hours or longer? 00:01:33
In between these events. 00:01:35
Separate declarations have to be declared. 00:01:36
By the Board of Supervisors. 00:01:39
And this second flooding event happened widespread in Arizona. 00:01:40
So there's a possibility that other municipalities. 00:01:45
Such as Tempe. 00:01:48
Which sustained a large amount of damage. 00:01:49
Is more than likely going to declare emergency. 00:01:52
So we get to combine their damages. 00:01:55
With gila county estimated damages to see if. 00:01:58
This separate event. 00:02:01
Can meet the threshold of the 13 million required by FEMA. 00:02:03
To get reimbursement at a higher level. 00:02:06
So this separate event did. 00:02:09
A tremendous amount of damage again. 00:02:12
In in the town of Miami and some damaging globe. 00:02:15
As well as some damage to properties. 00:02:18
In Gila County unincorporated areas. 00:02:21
And that's why I'm. 00:02:24
Here to present this and I do want to point out. 00:02:26
One item. 00:02:29
I think it's the 1234, the 6th item. 00:02:31
Down in this declaration. 00:02:34
Allows. 00:02:35
Or allows employees. 00:02:38
To accrue top time. 00:02:40
And we will overtime pay. 00:02:41
For this particular event. 00:02:44
So that that is one of these things we've been asking. 00:02:47
The employees to heal, the county to help us out with that. 00:02:50
And Mr. Menlove has worked with Rick. 00:02:53
Tusk and Marin Belling. 00:02:55
And and they believe that this needed to be addressed. 00:02:57
Were for this particular event. 00:03:01
And that's. 00:03:04
After my presentation, I'd be happy to answer any questions. 00:03:05
Any member of the board. 00:03:08
OK. Thank you, Michael. Supervisor Humphrey. 00:03:11
Yeah, Michael. 00:03:14
That item that. 00:03:17
That deals with the employee. 00:03:19
That is for just this recent event, not past event or not events. 00:03:21
Future just this single event. 00:03:27
That is correct, Sir, and I believe there might be talks with Mr. Menlo. 00:03:31
Possibly about a future policy change. 00:03:36
To be brought in front of a board to address this particular issue for. 00:03:38
All emergency events in the future. 00:03:42
OK. Yeah. Just wondering because. 00:03:45
Most of those guys are. 00:03:46
Are beating up their overtime. 00:03:48
Before the board meets or before the storm is even over with. 00:03:51
And and so you know, if if we don't kind of. 00:03:55
Do something for the future. 00:03:58
I guess it's too late to do anything for the past at this point. 00:04:00
But the overtime that they're occurring. 00:04:04
From this storm. 00:04:07
Will help because some of them would like to bank time off. 00:04:08
Rather than just get payment. 00:04:12
And so that increases that from 80 to 120 hours as well. 00:04:15
That is correct. 00:04:23
OK. Yeah. And then? 00:04:24
I could say if we could. 00:04:26
Oh, my apologies, it allows them to use it. 00:04:29
Within one year. 00:04:31
OK. 00:04:33
OK, that's great. 00:04:36
I appreciate it and like I say, at some point in time it'd be nice to change it because. 00:04:37
We seem to have fires and floods plaguing. 00:04:42
Plaguing us and who knows? 00:04:45
What's happening next? You know, if something happens to one of the mines or something and. 00:04:47
You know, creates an emergency situation. 00:04:51
It would be nice to have something. 00:04:53
Already. 00:04:55
For our employees that we depend on. 00:04:57
And they're so gracious to work as much time. 00:05:00
As they have. 00:05:03
For the community that they live in. 00:05:04
Absolutely, Sir, and I believe. 00:05:08
Mr. None Love and and the team are are coming up with some ideas. 00:05:10
Very, very. 00:05:14
Will possibly talk with the board about. 00:05:16
I thank you very much for. 00:05:18
For this. 00:05:20
Mr. Ben Lovin. 00:05:22
Michael and everybody that. 00:05:23
Had a part in getting this together for. 00:05:24
So I want to thank you very much. 00:05:28
For for calling this meeting today. 00:05:31
To address. 00:05:33
These events. 00:05:34
Thank you, Supervisor. 00:05:39
By the Klein. 00:05:41
Yeah, that was gonna be my. 00:05:43
Question exactly so think. 00:05:45
The him for bringing that up. I'm glad that. 00:05:47
That's somewhat addressed and I look forward to. 00:05:50
Having more discussion on that in the future as well. 00:05:53
Thanks for doing that. 00:05:56
Right. And I only I want to follow up with that as well, so. 00:05:59
The prompt time I understand what comp time is. Is that the equivalent though of time and 1/2? 00:06:03
Or would that just be straight time? 00:06:09
Sometime, I believe is. 00:06:14
For non exempt employees is time and 1/2. 00:06:16
For exempt employees. 00:06:19
Right now there is no. 00:06:21
Pathway forward. 00:06:22
To. That's one. 00:06:23
Considerations. Mr. Menlove is coming up with the present. 00:06:26
The board to allow. 00:06:29
Payment to exempt employees for some of the overtime they've put into these events. 00:06:32
And federal law requires that exempt employees. 00:06:36
Get paid at straight time. 00:06:40
OK. So in other words, those who are on salaries? 00:06:44
That end up working 80 hours in one week would be. 00:06:47
40 hours later. 00:06:51
That's correct if there's a policy in place. 00:06:54
Yeah. All right. 00:06:57
No that that sounds fine. 00:06:59
I have no other questions. 00:07:02
So if there's nothing else, I will call. 00:07:04
All promotions on this item. 00:07:06
Just one second. Oh. 00:07:08
But with with bringing that up, Michael, is that in this? 00:07:10
You know, you said line 6. I I don't have line 6 in front of me or seven or three. 00:07:16
But anyway, does that include? 00:07:21
So our salary people are taken care of as well for their overtime. 00:07:24
In this event. 00:07:29
Or were they taken care of last event? Because that's already. 00:07:31
In the policy. 00:07:35
I believe Mr. Menlove has plans of. 00:07:38
Of possibly bringing forth a policy to address that for exempt employees. 00:07:41
At next Tuesday's meeting, Sir. 00:07:46
OK, so it will, it will be, it will be addressed. 00:07:49
But not. 00:07:52
Not not on this today, but it will be addressed. 00:07:54
And not forgotten. 00:07:57
Mr. Chairman. 00:08:00
Mr. Chairman. 00:08:01
This is James Menlo. 00:08:02
Can I take a moment? 00:08:04
We spent about. 00:08:06
An hour and a half, two hours to stay talking just specifically about this issue. 00:08:07
Of helping our employees to be compensated. 00:08:11
Fairly in a way that. 00:08:14
Helps them know that we appreciate all that they're doing they have. 00:08:16
As you have pointed out, Sir Roger Humphrey. 00:08:19
A super a super effort. 00:08:22
To go out and make sure. 00:08:25
People of Gila County are safe. 00:08:27
And secure. 00:08:29
And we want to acknowledge that and respect them and try to get them compensated in the way possible. 00:08:30
Already in our. 00:08:37
And our policy, it elutes that into this paragraph that the. 00:08:38
The appointing authority, or the public works director in this case, has authority to. 00:08:43
Determine if an employee is paid out. 00:08:48
In comp time. 00:08:50
Or actual money. 00:08:52
Dollars so the. 00:08:54
Hug works director can make that. 00:08:56
Has that discretion to make that? 00:08:58
Call. 00:09:00
Of how each employee can be paid. 00:09:01
So if there are specific employees that want to be paid in comp time. 00:09:04
They can be. 00:09:08
If there are employees that want to be paid out in overtime dollars, then they can be. 00:09:09
For all employees that are hourly. 00:09:15
Or non exempt. 00:09:17
They get paid. 00:09:19
They get compensated for any overtime. 00:09:20
At time and 1/2. 00:09:23
So anybody that works? 00:09:25
Well, umm. 00:09:29
I don't want to get too. 00:09:31
Deepen the leads for. 00:09:32
Fair Labor Standards Act laws and all that stuff that. 00:09:35
An employee that works. 00:09:39
Beyond. 00:09:40
An ADR. 00:09:41
Two week pay period. 00:09:42
Then they get paid, they get compensated time and 1/2. 00:09:44
Or complaint. 00:09:48
That is attitude. 00:09:49
We included Mr. Troy White, Interim Public Works Director, in our conversation and. 00:09:51
He recommended the additional 40 hours. 00:09:56
At this point in time. 00:09:59
It becomes real difficult if we are giving too much comp time. 00:10:01
And it becomes a real challenge to be able to schedule. 00:10:05
Future work that's. 00:10:09
Understood next winter and everything that they do so. 00:10:10
This is a recommendation of the additional 40 hours. 00:10:14
Available for accruing comp time. 00:10:17
A recommendation of Mr. Troy, our interim public Works Director. 00:10:20
Thank you. 00:10:26
All right, there's. 00:10:28
I think that's all the questions that represented it. 00:10:32
And we are. 00:10:35
In that discussion, looking at. 00:10:37
Bringing some. 00:10:39
A few more changes that will be permanently. 00:10:41
Put into our policies. 00:10:44
And bringing those to you as soon as we can. 00:10:46
So that. 00:10:49
Want to look long term but that we. 00:10:50
That was concluded discussion. 00:10:52
This to. 00:10:54
Get employees. 00:10:55
Taken care of for this next pay period which will be paid. 00:10:57
A week from Friday. 00:11:02
We wanted to get this the comp time issue addressed. 00:11:04
Real quick. So that's why that's included here in the. 00:11:07
Declaration today. 00:11:10
Appreciate you doing that. 00:11:14
If there's no other discussion. 00:11:15
Then I'll call for a motion. 00:11:18
Mr. Chair, I make a motion to adopt resolution #25 dash. 00:11:20
10/04 issuing. 00:11:25
Declaration. 00:11:27
Of emergency due to flooding from the rain storms. 00:11:28
In the in the city of Globe. 00:11:32
Out of Miami, Claypool unincorporated Gila County. 00:11:34
And the San Carlos Apache Reservation and authorized the chairman. 00:11:38
Of the board. 00:11:42
Of supervisors to take all further actions. 00:11:43
As may be necessary. 00:11:47
To appropriate. 00:11:50
Or appropriate to implement. 00:11:52
This declaration pursuant to a. 00:11:54
Through Arizona. 00:11:57
Revised statue. ARS 26-3. 00:11:58
11. 00:12:02
And Mr. Chair, I'll second that. 00:12:05
OK, we have a motion and a second. Charlotte, would you please do a roll call vote? 00:12:08
Chairman Christianson, may I have your vote? 00:12:16
Aye, Vice Chairman. 00:12:20
Klein, may I have your vote? 00:12:24
Aye. 00:12:27
Aye. Motion passes. 00:12:30
OK. Thank you. 00:12:34
What else do we have to do today, people? 00:12:36
I believe that's it, supervisor. 00:12:40
Yeah. Thank you very much. 00:12:46
And we will see everyone on Tuesday. 00:12:47
OK. Thank everybody for putting so much time into this. 00:12:50
Thank you. 00:12:55
Has left the conference. 00:12:58
